Ok, I can't access this whole article, but the summary sentence is enough:

A federal appeals court said a Texas death row inmate cannot raise the issue of mental retardation because of a missed deadline.

"Sorry, we don't care if you are mentally retarded. You didn't meet the deadline to bring it up." Great, so now there's a time limit on deciding, you know, whether or not to kill someone?!?!

The Supreme Court won't let Bush and Texas have their fun anymore. They said executing people with the minds of 6 year old s is a no-no.

Well, if his lawyer missed a simple deadline to file papers on his DEATH ROW client, maybe he can get a new trial based on his lawyer's mental retardation.
