A man who accidentally shot a passing motorist in the leg while trying to kill a cow has been fined $1000 and banned from holding a weapons licence for five years.

Rudolf Stadler, 51, from Mooloolaba on the Sunshine Coast, was found guilty by a Brisbane District Court jury of one count of a negligent act causing bodily harm to 46-year-old Carrie Tunning.

Judge Douglas McGill today fined Stadler $1000 and ordered that no conviction be recorded. He gave him three months to pay the fine.

Although he noted Stadler was so distressed over the accident that he had promptly handed in his weapons licence, Judge McGill banned him from obtaining another one for five years.

The accident happened on April 17 last year when Stadler offered to kill a cow for his hobby farmer friend Paul Tyson, on Mr Tyson's Caboolture farm, north of Brisbane.

Luring the cow to a shed with molasses and hay, Stadler drew his Winchester bolt-action rifle and shot at the cow.

The first shot missed and the second went through the back of the shed and then through Mrs Tunning's car door as she drove along Beachmere Road and into her leg.

Mrs Tunning, who was returning to Brisbane from a holiday with her husband, John, at the time, told the court she heard an enormous noise and looked down to see blood on her leg.

In his sentencing remarks, Judge McGill noted it was a "freak accident" with no malice or intention on Stadler's part.

"You have been personally quite distressed that you have caused this injury to a woman passing by," he said.

"There was no intention to do anyone any harm and in these circumstances your actions must be regarded as a mistake, although a mistake you really should not have made."

While Mrs Tunning fully recovered, the cow was not so fortunate: it was eventually shot by Stadler.

Stadler declined to comment outside court.

How, pray tell, can you miss while shooting something as big as a cow (and from close range!):rolleyes:

Actually I don't know how gun ownership is handled here (shame on me) - but how in hell's name can someone like that get a gun?
And why would you shoot a cow in a shed?

I think this article makes it clear that cows should be given the right to bear arms so that they may defend themselves against would be assasins.

On a serious comment...even though I am, what most people would consider, a liberal, I still believe that people should be allowed to own and operate weapons.

That having been said, I believe that weapons should be regulated. Certain weapons should be off-limits to civilians (honestly...you don't need an M60 to defend your home, unless you want alot of small holes in your wall), and their should be a strict no-tolerance policy for misuse.

Gun ownership, in my opinion, should be a privilage, not a right. But hey...who am I to change the US Constitution... :headbang:

Not to stray off topic, but I thought I'd take a moment to address your point. The ownership of fully automatic weapons has been illegal in the US since 1938, so no M-60's for me. Unfortunately. It would be fun though...

Some people should not operate hair dryers, or otherwise why would they have to come with warning labels of "Do Not Use In The Shower"? MANY people shopuld not operate vehicles, after having to take a licesne test, vision test, driving test, maintain this testing every X number of years, and have government mandated multipe saftey devices all over the thing, STILL manage to kill far more people than firearms, which number of recorded accidets in the US has steadily dropped.
What happened to this guy is appropriate - action against him personally, instead of banning all Winchester bolt action rifles for one guy's idiot act. Here we would probably prosecute for negligence, but if you guy want to just let him go for such a stupid careless act, hey, that's your country. Maybe your Stasi should search his house for anything potentially lethal, with this much demonstrated incompetance!
But hey...who am I to change the US Constitution... Why, how right you are, sir! Thank you!

No, sir, the National Firearms Act of '34 restricts Class 3 firearms severely, but they are still available. An M60 will run you about $30 - 40 thousand dollars, as the FOPA of '89 stopped civilian production of full auto. All fully transferrable full auto was made before that point, so they all shot so far up in value as to be pathetic. A MAC10 for $1,700 ? That's nuts - dadgum POS isn't worth the $200 they used to charge for them
There is a limited production semi auto only M60 out there, also quite expensive, but non-NFA.

You are absolutely correct (I was wrong on the date, thanks for correcting) , and I am aware of that regs. I was just trying to keep it simple...

The full auto would be fun but it's a little rich for me. I've got a Dillon progressive press, but even then you'd burn a lot of components. There's a full auto BAR in town, I'm hoping to get to the range at the right time and try it. Just for fun.

Ah, Sabbatis, a person after my own heart - I just spent some time at my single stage press, and built another 40 testers for my CZ75 PO1 9mm, with some Berry's plated 124gr bullets, FP and HP. Next weekend, to the indoor range I go!

Nice to meet a fellow reloader, there's only a few on this forum from what I can tell. It's a significant interest of mine, primarily centerfire rifle. I shoot a lot of cast, hence the Dillon.
