FEDERAL JUDGE HALTS NEW ORLEANS GUN SEIZURES
Second Amendment Foundation (SAF) press release

BELLEVUE, WA ? The U.S. District Court for the Eastern District of Louisiana this afternoon issued a temporary restraining order on behalf of the Second Amendment Foundation (SAF) and National Rifle Association ( NRA), bringing an end to firearm seizures from citizens living in and around New Orleans.
District Judge Jay Zaney issued the restraining order against all parties named in a lawsuit filed Thursday by SAF and NRA. Defendants in the lawsuit include New Orleans Mayor Ray Nagin and Police Chief Edwin Compass III.
This is a great victory, not just for the NRA and SAF, but primarily for law-abiding gun owners everywhere, said SAF founder Alan M. Gottlieb. We are proud to have joined forces with the NRA to put an end to what has amounted to a warrantless gun grab by authorities in New Orleans and surrounding jurisdictions.
Over the past three weeks, he continued, residents who had lost virtually everything in the devastation following Hurricane Katrina had also essentially been stripped of something even more precious, their civil rights, and their right of self-defense, because of these gun seizures.
SAF and NRA had no alternative but to take ac! tion, Gottlieb added. If these gun confiscations had been allowed to continue without challenge, it would have set a dangerous precedent that would have encouraged authorities in other jurisdictions to believe they also could suspend the civil rights of citizens in the event of some other emergency.
What must happen now, and quickly, said Gottlieb, is for authorities in the New Orleans area to explain how they will return all of those firearms to their rightful owners, and do it promptly. What this ruling affirms is that even in the face of great natural disasters, governments cannot arbitrarily deprive citizens of their rights. Thanks to some great teamwork between SAF and the NRA, this sort of thing will hopefully never happen again.

No, not good! Normally I would be all for it, but when you have people wandering the streets of New Orleans shooting police officers, sorry, but that has to stop.

That much is true, but guns were being confiscated from legitimate gun owners who were doing nothing more than protecting their families and stores.

You mean how they were using the CC registry to target legal owners and yet weren't disarming PRIVATE security people (aka citizens w/ guns).

So it's discrimination to disarm criminals carrying illegally but not citizens who followed the laws to carry?

Oh? The law discriminates all the time. And a failure to do so would be catastrophic. One law for drivers and pedestrians? One law for predators and prey? One law for any number of recognized differences between people? Your argument doesn't hold water. Guns are confiscated from criminals all the time. To confiscate them from legitimate gun owners would be a miscarriage of justice. Besides, in the US, it's unconstitutional.

This is good news. Now that there's significant opposition to the gun-grab, Nagin blames the police chief for the idea and denies culpability in the gun-grab decision. What a bunch of politicians!

Who will pay for the guns confiscated so far - FEMA? New Orleans is broke.

"In response to a lawsuit filed by the NRA, New Orleans Mayor Ray Nagin said Friday night that he never authorized the taking of weapons from citizens.

The National Rifle Association filed a lawsuit in federal court, claiming that the confiscation of guns from private citizens, as ordered by New Orleans Police Chief Eddie Compass, was a violation of the Second Amendment. On Friday, a restraining order was issued in federal court barring any further weapons from being taken.

Nagin's office issued a statement Friday that Compass made statements about taking weapons from citizens without Nagin's knowledge. Compass said no weapons had been taken.

Nagin said Friday night that he has no intention of issuing orders to confiscate weapons."

Considering that W has publically opposed gun control (he's from Texas and acts like a cowboy, for crying out loud), and he pretty much is the federal government, then yeah sure. BS.

If you're saying this in a joking manner too make fun of the crazy "fight the power, whoever that may be" nuts then I applaud you for doing so and apologive for missing your sarcasm (and maybe an armadillo hat for comic effect).

If you are actually wearing a foil lined armadillo hat then I can't help you. At least you'll never win an election or get a dangerous job, considering you're running around in an armadillo hat, and I won't have to worry about that. Maybe the UFOs can just keep you after your next probing.
