Nominee Roberts's confirmation hearing has started.

Currently going on right now, is opening comments in the Confirmation process of Bush's nomination as Chief Justice of the Court of the United States.

How do you people think this hearing is going to go?

Frankly, I think that the White House refusal to release documents that historically would have been released for such a hearing gives a perception that there is something to hide which the Democrats will use to turn this into a fairly acrimonious affair.

However this very same refusal to divulge starves the Democrats of much ammo given that there is very litle other judicial record on which they can base any substantive objections.

So it will be nasty, but it will not be a long drawn out affair as such things go.... unless a skeleton falls out of a closet somewhere.

The Republicans are obviously going to give him the green light.

I think that the Democrats will use it to lay the groundwork for denying Bush's NEXT nominee.

he'll almost certainly get in (and frankly, he's the best you could've expected, considering who bush's nominated for other positions. he's a real judge, appears willing to respect the law, and doesn't think the supreme court should be destroyed), but this will be a good opportunity for democrats to draw some attention to some of the corperate malfesance/environmental protection/minority protection issues that they'll need attention on for 2006. sadly, it'll likely end up being mainly "we believe in things too" style posturing since they really can't stop him bein confirmed

Taking all bets on what the big litmus test will be:

Odds are ...

1] Gay Marriage Amendment (3:1)
2] Roe v. Wade (2:1)
3] Bush v. Gore (5:1)

Minimum bet: Your soul and sense of rational decency.

roe v. wade, definately. arlen specter is a powerful, pro-choice republican and democrats know they might be able to get his backing on questions regarding it, so they'll ride it for all it's worth.

Good call. I'm hoping it gets exciting, though. Maybe someone will throw him a bizarre curve ball like Plessy v Ferguson or somethin' like it.

Or maybe .... just maybe ..... SCOTUS Cage Match!

Absolutely. I'd imagine most of the Democrats want Roberts to pass because he's the most moderate person Bush will nominate. They'll give him a hard time about it, though, so that when they finally do let Roberts through, it'll look like they were the ones compromising.
