OLATHE, Kan. - A high school student convicted of battery for vomiting on his Spanish teacher has been ordered to spend the next four months cleaning up after people who throw up in police cars.
Johnson County Magistrate Judge Michael Farley said during the sentencing Tuesday that he considered the boy’s actions “an assault upon the dignity of all teachers.”
The teen, now 17, vomited on teacher David Young as he turned in his textbook on the last day of classes at Olathe Northwest High School. His attorney, Brian Costello, said the student vomited because he was nervous about his final exams.
But two other students testified that the teen said he threw up intentionally. One girl said he told her in advance that he planned to throw up on Young on the last day of school. The girl wasn’t in class when the teen threw up, but she testified that the boy later told her, “You missed it. I did it.”
Young said the student, who was failing his class, made no effort to avoid throwing up on him. “I was just sort of stunned,” he said.

Holy puke! I did pretty much the exact same thing by accident in intermediate school. I vomited on my 7th grade algebra teacher, her desk, and a large number of mid-term exams because my mother thought I was faking sick. I never lived that down. (Many, many years later, my father was asked if his son was the same Daistallia who had vomited on Teacher X's desk - by his opthamologist!)

Vomitting is not a voluntary action unless they put their fingers in their throat and induce the vomit reflex like Bulmics do. So, it seems almost entirely unfair that this student would be given a harsh sentence. I think it's going too far. It's silly to punish people for bodily functions beyond the normal realm of self-control.
I probably would've wound up vomitting on a college professor if she hadn't let me flee for the bathroom during the midterm exam. I was writing it despite not feeling well because I didn't think a headache would make a difference. Luckily I got to puke in the bathroom.

So far as I can see, the only defining part here for the conviction and subsequent sentence is motive and intent. Was there motive? Don't know, wasn't stated. Was there intent? Seems so according to the witnesses.
So what happened was someone intentionally puking on a teacher or so it seems. Would be the same if the person upended a rubbish bin on the teacher or flung excrement like a monkey.
It's an attack...of sorts. Still punishable.
Intent is usually the maker or breaker in these sorts of cases.

Yes and I can burp on command. But, even still, it seems harsh until you know both sides. And, you know, students do enjoy twisting the words of students they don't much care for out of spite.

Vomitus is a biological hazard...and a wet one at that. It has the potential to spread disease. Also, have you ever seen the damage stomach acid can do to skin? Least of all is the disgusting necessity of cleaning the mess up. Considering this kid had told other students he planned on vomitting on his teacher and the potential for serious harm from his actions, he got off pretty easy. Maybe if he has to clean up a few accidental messes (especially the fully loaded beer and pizza ones) he won't be so quick to attack another person in this way.

The teen did tell others he was going to do it, and syrup of ipecac is good for making people vomit.
We had a case at my school where I and other people overheard a student telling another student planning to do precisely that to the principal at graduation, because he had been suspended for being disruptive repeatedly. Reports were written and timestamped, and the student warned that should he become sick on the principal at graduation, assault charges would be promptly filed.

Lighten up...this was probably an attack on the person, not the position. However, I think that the punishment was fairly justified. People should respect each other, not authority, however.

I've been able to vomit at will for 20 years- no fingers down the throat, no vomiting agents or tricks-I dont need to bend over.
I can bring up a little or all and I can do it while I'm walking.
I would have no problem covering someone with vomit if I wanted to.

If the female classmate's testimony can be believed, then the punishment was *probably* appropriate (I'm too young to have true perspective about whether it was excessive, insufficient, or just right).
