Should morons be treated differently from terrorists?

So this genius from Oklahoma built a pipe bomb out of blackpowder, a metal pipe, and those little ignitors that are used to trigger model rocket engines, then he took it on a plane. When authorities found it his brilliant excuse was that he'd forgotten that the bomb was in his luggage.
Whether he forgot or not, whether he's a moron or a terrorist, I think it's only reasonable to give him a sentance comprable to Richar Reid or any other failed terrorist. He put the passengers and crew in just as much danger.

1st off, he didn't get it onto the plane. the screeners found it before that happened.
2ndly, he's a dumbass, he's no richard reid who actually _tried_ to blow up a plane. This retard, if you believe his story, wouldn't have attempted to.
i do however think he should be sentenced, and if his prior criminal history tended to be about explosives or subversion, i would book him hard. otherwise, fine him and let him go.

He should get whatever sentence you would receive for trying to smuggle explosives. However, uless they can prove that he intended to detonate it, he should hardly receive a life sentence, but I think a few years (maybe a decade or so) of prison would do him a large amount of good.
He just sounds like an idiot to me. How do you forget something like that being in your bag? The charge should be criminal stupidity if anything.

We dont need actual terrorists with defense attorneys arguing they forgot bombs were in their luggage.

I have no need for terrorists and I certainly have no need for forgetful bomb-builders.
I was under the impression that the very creation of a pipe bomb is a criminal offence in and of itself let alone the criminal offence of attempting to bring a deadly weapon (in this case the pipe bomb) aboard an airplane. But hey what do I know, I'm only Canadian :D

It all depends. If he really is a moron, then just a smuggling explosives charge, not a terrorism charge, is in order. I wouldn't give him jailtime though if it was an honest, though retarded, mistake.
If there is anything that suggests that him being a moron might be an excuse, he should be charged with attepmted terrorism, and given jailtime.
But to answer the big question - yes morons should be treated differently from terrorists. They may seem to have done the same thing, but the devil's in the details.

Seems to me that having the bomb in his luggage and attempting to get access to the airplane is compelling evidence of intention.
What's the difference between trying to get it through the gate, or carrying it a short distance onto the aircraft? There's no choice but assume his intent - there are no end of signs informing people that explosives can't go on a plane, not to mention the common sense aspect.
He should be charged as a terrorist, maybe a judge will give him a little slack for the circumstances. Can't control what the judge does anyway.

Yes-you're right. Creating one is a crime. Let alone extremely stupid if you arent trained in handling explosive materials. And honest people that are trained DONT build pipe bombs.
Possession of one is a crime.
Bringing one to the airport is likely an additional crime.
Trying to board a plane with one yet another.
Being this stupid, even if he is truly this stupid, is a crime too-against nature.

I'm sure defense attorneys have and will argue this. This is why we have juries who weigh the evidence, etc.
Oh wait, not for accused terrorists we don't.
