'Three Stooges' Action Lands Boy in Court

GOLD HILL, Ore. (AP) — A 15-year-old boy who pinched and twisted the nipples of a 13-year-old has been sentenced to three days of community service for harassment.

David Thumler, 15, said the "titty-twister" was just horseplay. The mother of 13-year-old Matthew Cox counters that the incident was humiliating for her son, who saw it as an assault from an older, bigger bully.

"They're not friends," she said. "If he was my son's friend, it would be a different thing," said Bobby Cox.

In addition to the community service, Thumler has been ordered to pay a $67 fine and the misdemeanor has been placed on his permanent record. He can request to have it removed when he turns 18.

Ken Chapman, a Jackson County juvenile probation supervisor, said Oregon law defines physical harassment as "offensive physical touching."

That includes such adolescent antics as "wet-willies," "wedgies," "swirlies," "noogies" and all other forms of "Three Stooges" behavior, Chapman said.

According to David, the two boys were in line at a local deli when Matthew jokingly made an embarrassing remark to the female clerk about David. In retaliation, David counterattacked with the "titty-twister," the 15-year-old said.

"It's a thing of camaraderie," David said. "If he's going to assume our friendship is on that level, then so am I."

A lawyer hired by the 15-year-old's family called the juvenile court's actions "Orwellian."

"They call this 'baby assault,'" said Michael Kellington, a criminal defense attorney in Medford, hired by the family.

Even Bobby Cox said she was surprised to hear that her husbands' call to Gold Hill police resulted in court time for the boy. "Nobody informed me it would be a full-blown trial," she said.

Maybe on a woman, but on a kid this is a little ridiculous. It would be funny to have him in jail; I'm sure other inmates would give him more than a titty twister. ;)

To be fair its not like it was just a friend messing around. If someone I didnt know came up and twisted my nipples I'd beat the shit out of em. unless it was an attractive lady. but they're rarely into that.

I'm no great fan of lawsuits, particularly ones that seem to have no real justification in the first place, but this type of thing strikes way too close to home for me. When I was very young, I was very skinny and not strong at all. There always seemed to be a few weak-minded bullies who felt the need to humiliate those weaker than them. I was on the recieving end of this in grade school and middle school all too often. If I could have sued their sorry asses, I would have. Instead, I had to wait until the physical and mental discipline of the US Army taught me to stand up for myself and built me up physically to the point where I was eminently capable of doing so. :)

I should point out that the kid was sentenced to three days community service, not jail. Heck, for you communists out there, community service isn't even punishment, it's duty (to the collective good and to your community)!

so this was started by the parents (father to be exact)... not the kids... not the police who have to take each call seriously.

what would've happened if the parents talked to each other first.

the kids might've become friends at best. [sigh]

It's about time, physical bullying of all types deserve the harshest punishments they can incur. You see, guys can't pull the whole sexual harrassment thing when it happens to them, so males bullying males can get away with it.

While I agree they should not have gotten off scott free taking it to cort hardly seems like a worth while application of the court system and hardly effective

Personaly parents got to step up

If I had done that to someone and my dad found out ... that court would be a cake walk compared to what I got

I fucking hate those, but going to court for giving one? Wow.... just wow. People sue too much these days. I do not see the punishment fitting the crime. The punishment is too much really. It's only a god damn titty-twister. They hurt, but oh well. If you get one, oh well, deal with it. There is no need to waste courts times with stuff like this.

It's physical harrassment no matter which way you cut it. This kind of crap cannot be tolerated. A line must be drawn and grabbing and twisting the flesh of another person to deliberatly cause pain is a good start!

It is minor physical harrasment. It's nothing that needs to become a legal matter. Courts have bigger crimes to deal with.

So, if were going to start having srimnal prosecutions for any and all mostly harmless acts like these, where does it stop?
When do we start screaming for the police, and judges when someone hurts our feelings, claiming emotional bullying?

Doing this kind of things only wastes tax-payer money out of towns with small budgets, and makes people rely on the court systems to raisde their children.

You want to stop bullying, thats great.
Start it at home, not in the courts.

An American police deparment decided to match wits with this case. In a game of truth or dare, a fifteen year old girl dared an eight year old boy to touch her breast. The boy's parents found out about this and phoned the police. The police on the scene decided to make an arrest - the eight year old boy - for assaulting a "we must protect at all costs!!!!!" teen female.
Only after both sets of parents spent all weekend screaming and spitting on the police, they released the boy.

I'm more appalled that this matter even got to court than the events that transpired in the first place. Granted, titty twisters hurt like hell, but dammit parents can punish a kid just as easily--and more effectively. Average kids are more afraid of what parents will do than what cops will do.

Lazy-ass parents. Stupid lawyers. Case closed.

The title made me rather disapproving, but skimming the article, I kinda approve of the sentence. It seems the kid really was a bully and twisting the kid's nipple isn't a nice thing to do. If it was among friends, I don't think it would be wrong.
The kid that got picked on deep inside of me is jumping for joy that the bully got a sentence. And three days community service isn't exactly something that would be harmful to someone's personality, is it? ;)

I got beat up as a kid as well but wasting the courts time for something like this just seems silly this is something the parents should have handled
