This has probablly been done last week, I wouldn't know since I was out of the country, but just in case it wasn't, or even if it was, I'm going to do this.

So, the question is, with the Supreme Court judges starting to resign, do you want Bush to nominate a very conservative, moderate conservative, completle moderate, moderate liberal, or very liberal justice? And please explain why you choose what you do.

I'm going to set up a poll question now.

Personally I support the most right-wing judges possible, for I hope that they will overturn Roe v Wade, end affirmative action, end welfare programs, and end social security, among many other things.

Let's just assume the liberals will want a liberal, the moderates will want a moderate, and the conservatives will want a conservative :D

I would like a justice who respects the law and makes decisions based upon precedent rather than let politics cloud their judgement, as the case has been for the past few decades. A social moderate and economic conservative would be my choice politically, although anyone who actually interprets the law would get my support.

I'm partial to super-intelligent legal minds myself. My dream nominee would be someone from the defense bar who has a strong sympathy for actual rights (as opposed to invented quasi-rights), a brillant mind, is reasonably young and understands that govenment is not the same thing as society -Barry Schenck comes to mind.

What the resolution of the cases is matters less to me than how they are resolved. I enjoy convoluted arguments and theories which hinge upon barely supported facts stacked upon resonable suppositions extending onward until one finally comes to the conclusion on wants, but that is not how the law should be. In the past 50 years it seems the USSC has more and more of these, deciding how the case should be resolved and then twisting precedent and law to create the outcome desired. This means however that a citizen can no longer be sure what is legal and what is illegal, instead of looking at law and precedent to see how the USSC will decide a case spectators are looking to the ideology of the justices.

I'll pull back on my personal hobby-horse, and continue to adress the issue. I supose I would have to say conservative since with the Roberts nomination I've found out that The Federalist Society was a conservative organization. I cannot disagree with this essential conservative tenant (what the Federalist Society is all about encouraging), that the courts should say what the law is, rather than what they wish it to be. Learned Hand is my ideal Supreme Court justice though, but I hold no hope of ever seeing his ilk on the USSC.

Anyone who actually interprets the law according to who's views? No matter what decision a USSCJ final ruling is, there will always be someone scoffing their decision and calling it unconstitutional.

Well put. I love how the Liberals are up in arms about the idea that there might be a conservative put on the court, yet they have no problem with their hypocricy when they said nothing about an extreme Leftie being put on the Court. They are so afriad that Roe will be overturned, and although I absolutly detest that law, I understand that overturning it will have little actual effect. For more evidence of this read the editorial in the USA Today, today's issue.

There will always be extreme Leftists and extreme Rightists (like myself), and we cancel eachother out so a moderate can come into power. I, unlike many on the political fringes, understand my role as a counter-balance. Now if only the radical Left would realise this too...

First of all, there is no-one whose personal beliefs do not influence their decisions. Second of all, if judges only ever made decisions based on precedent, the law would never change. Assuming it were even possible, would you really want a judge who makes decisions based on old cases, rather than the present social context?
