This sounds a bit old to me but it is scary on a few levels; most notibly "this is what people resort to when there is no abortion".

The fact that this law exists is an interesting point to discuss.

The 'abortion' was consentual, though brutal. Should he be charged with a murder?

Why was he charged with TWO counts of murder? The girl survived...the baby died...??? I just count one. I just think these kids were stupid. Cripes. At least she didn't drink a 24 of Rye to try to miscarry...and end up with a severely FAS child...

Murder? No, definately not. Practicing medicine without a license maybe, but not murder.

Why couldn't they just go to an abortion clinic?

She said she just regretted not getting one earlier, I don't know the details.

Maybe her Mom/church pressured her to keep it, maybe she thought she wanted one, maybe she finallly SNAPPED when the gravity of the situation finally made itself clear to her. Could spend all day figuring reasons, really.

performing and illegal abortion, maybe. the girl wasn't prosecuted, this should say something in the case.

Not exactly 'medicine' now is it? Didn't try to pass himself off as a doctor. I guess it's the difference between going to the doc to get a Plantar's wart taken off with liquid nitrogen or doing it at home with a steak knife. Not illegal to do it yourself, but more dangerous and may result ina hospital stay or operation anyway.

Assault and Battery at the most but since it was consentual I guess that's out. That's how I'd rate it.

As I recall, it's a technicality of the statute that specifically says it can't be applied to the mother. Haha. Next time shoot her.

There's nothing wrong with practising medicine without a license as long as the patient is aware of it and signs a waiver.
