Personally I would go for cake, it's squidgy.

To be a biscuit it would have to be crunchy.

And it is, after all, called a Jafa"CAKE".

Jaffa cakes are neither a cake nor a biscuit, but a highly addictive drug which should be banned before it's deliciousness causes it's victims to become so blissful after the consumption of a YET ANOTHER packet that they fall into an orange jelly induced coma and never awake :cool:

Jaffa Cakes are of course cakes.
This was proven to the UK excise people who wanted to put VAT on them as they do chocolate biscuits. CAke it seems is exempt.
The makers made a huge Jaffa cake and demonstrated that when stale cake goes hard but when a biscuit goes stale it goes soggy.
This was accepted and cakes they are and remain (legally)
Which goes to show how pathetic tax decisions really are.
