Does anybody see something wrong with this?
For you lazy people, the gist of the article is this:
Worker at a custard stand sticks hand into machine for some reason, finger (finger tip?) gets cut off.
Customer finds fingertip in custard
Customer REFUSES to give back the fingertip
Customer declares that he will be calling TV stations and his lawyer
Worker loses fingertip, most likely for good.
Now lets see, I think that taking somebodies finger and stashing it in your fridge when a doctor has asked you for it is called 'theft' at least.
And the guy has the gaul to threaten to SUE the custard stand!
Im inclined to agree with this quote:
"It's a mystery how that customer can live with himself after he refused to return the finger so that doctors might try to reattach it," said an editorial Thursday by the Star-News of Wilmington.
"Unless he offers a better explanation for that decision, people will assume that customer Clarence Stowers cared less about another person's loss of a body part than about his chance to squeeze some bucks out of the custard stand."

I do believe medically a doctor may not be able to reattach the finger any way, because it's been far too long since it was detached... so, it doesn't really matter any way if that's the case. Besides, if the person was so concerned with getting his finger back, how come he didn't search for it before it ended up in a cup of custard?

Yes, but the doctor was (from what I gathered) at the scene WITH THE CUSTOMER, and the customer wouldnt give the finger back.
I presume the worker guy didnt fish around for his finger because he didnt want to lose another one.
Its still a blatant ploy for 15 minutes of fame and a nice cash settlement. I hope the custard-stand employee sues the guy for a few million myself :P

If any lawyer tried to bring a suit against the custard stand on behalf of the moron who stole the finger, he would probably get disbarred for filing a frivolous lawsuit. There is no way that idiot could possibly claim he was emotionally or mentally harmed after carrying on like an idiot. I hope he gets sued by the employee for every penny (which probably isn't much).

It wouldn't really matter... they always tell you that if you lose a finger, toe or whatever, to bring it with you packed in ice to the ER. If a certain time passes, it might not be able to be put back on.
I'm assuming that this incident didn't happen bang bang bang. That is: I don't believe that everything happened right after one another as if employee lost finger, it lodged into custard, customer comes to shop, buys custard, eats finger... which would suggest the finger wouldn't be salvaged anyway.

Well, why didn't the shop close up to find the finger? I mean, there's health code violations up the wazoo for something of this nature, I'm sure of it. It may not be commonplace, but if he lost a finger there was blood, and if the finger ended up in custard... wouldn't blood end up in it, too? I would think the shop would've closed down to clean up, throw out the custard that might have even had the slightest chance of being confiscated and filed reports to the proper authorities. That's why I brought that point up... of course he's going to be screaming and freaking out over losing his finger.
If any type of lawsuit is filed, I'm sure the finger in question will be used as evidence and legally he will have to give it up. I'm sorry, but I do think the customer has more of a claim to make a lawsuit, as the business hasn't appeared to actually have tried to clean up its mess and ensure that the finger or other components of the loss didn't end up in their products.

The thing that people don't understand is that to make out a lawsuit you have to show damages-- meaning that you suffered some harm. If you find a finger and jump for joy thinking you are rich you obviously haven't suffered any harm. If you are planning on filing a frivolous lawsuit you should at least shreik in terror, and pretend to cry uncontrollably and then make up some BS about how you are permanently traumatized.
You also have to show causation. Even if you caught some disease from the finger, it is hard to prove that the Custard stand was the one who caused it after you refused to give the finger back and ran all over town like a moron.

For Kohl's, Sunday's fingertip amputation was the second time in less than a year that a worker lost a finger on the same frozen custard machine. The worker was found by investigators to have been negligent in the July 2004 incident, and the state Labor Department cleared the company of wrongdoing.
I also wanted to point out that according to this (http://www.cnn.com/2005/US/05/06/finger.fight.ap/index.html) article, this same store has had two instances of the same machine cutting off an employee's finger in the last year.

Oh, I agree, I'm not saying there wasn't a chance... it just seems by the time everything played out and the finger was actually found odds are there wouldn't have been enough time. I've seen estimates he found it within 30 minutes up to eight hours later in various reports.
