CLEVELAND (AP) - A judge has ruled that Ohio's new constitutional ban on gay marriage prohibits filing domestic violence charges against unmarried people, a decision that prompted an immediate appeal by prosecutors.

Burk, 42, is accused of slapping and pushing his live-in girlfriend during a January argument over a pack of cigarettes.

His public defender, David Magee, had asked the judge to throw out the charge because of the new wording in Ohio's constitution that prohibits any state or local law that would "create or recognize a legal status for relationships of unmarried individuals."

I am not sure how this is relevent. It just means its no longer clasified as "domestic vilonce". Just being assult or GBH is enough isnt it?

Here in Iowa the law states that a domestic abuse is assualting someone that you live with, it doesn't have to be someone that you are involved with.

the only thing that matters if you are involved with them, or 'intimate partners' means that until you see a judge and such you have a no contact order placed and you can't have any firearms on or around you.

Does the legal proceedings for "domestic abuse" somehow significently differ from those followed under any other vilont crime (note: Vilonet crime meaning actual vilonce and not vilonce combined with robbery etc). Because if not I see no real problem here.

yeah, with domestic abuse there is an automatic no-contact order, meaning you can't come within 500 feet of them, and cannot communicate with them in any form, or 3rd parites. You have to go through a 6 week class or a year of jail time, for the first offence.

The no contact order is in place until you go through the classes, or until they are requested to be dropped by the assualted party.

it doesn't look at if you are married or anything. If a brother beats up a brother, its domestic, if a mother beats up an adult child, its domestic. they keep marriage and such out of it.

It's not the Bush administration who implemented the amendment (although they certainly are against gay marriages -_-). It is some citizens of Ohio who chose poor wording (and just an overall crap amendment). And apparantly the legislature is trying to fill in the loop hole for heterosexuals living together... but not gays. It's crap, and my state sucks.

Well, I don't hate my city as much at least. I live in Cincinnati where we got Issue 3 passed (which repealed Article XII)... about the only good thing that happened for the GLBTQ community last election. I also have the joy of living on the boarder of Kentucky (where I attend NKU) which also passed an amendment...

Used to live in Cincinnati, and I'd say it is the only part of Ohio I like besides Columbus.

You know, I liked Gold Star, but this was due primarily to the Chili Cheese Fires. Coneys were always better at Skyline. So overall, I'd go with Skyline.
