yep, that's right, sweet innocent little Tinky nearly got into trouble in Morcambe
I had a bottle of vodka in my handbag cos i was putting it in mine and my friend's drinks and I got caught by the owner of the clubhouse. We were stood around talking to this football team (*drool*) and she tapped me on the shoulder and said
"please could you come into the toilets with me a minute"
so i gave my drink and my bag to my friend, so she said
"bring your bag with you"
so i was like 'shit' so i followed her in and she said
"empty your bag out please"
so i said
"HOW RUDE! NO!"
so she said
"look, I'm the landlady, I can do what I want, you empty your bag or I'll do it myself"
so i took the vodka out and she got out her phone and said she was gonna call the police so i turned the waterworks on and made up this story about how I've wanted to be a policewoman all my life and they'll never let me on the force if I have a record so she let me off.

I used to know a guy who always sat in the corner in a huge trenchcoat at all times of the year. Bottle of scotch in one pocket, whiskey in another. Bought a few scotch and cokes to keep suspicions at bay, and a few straight cokes. Took me two years to figure out what was going on. I don't think the bar staff ever noticed either!

I don't know how, "they" do that. Every time I've tried to drink something I brought with me, I've been caught in an instant. Sitting on a pub roof with one friend and nobody else around, and the instant I top-up the pint I bought from a can I had left (it was London, the pint was shite to begin with, so the canned effort didn't really make it any worse), the land lady's head appears at the top of the stairs.

I was playing pool with some 35 year old American lady in a pub in dunedin (2 bears, if I remember correctly) mostly because she kept paying for drinks and games of pool. Strangely though, she hardly bought herself drinks as she had a few cans of beer in her pocket that she toped up with in the corner. Never got caught while I was there.

So it is illegal? And she could have lost her alcohol licence had you been caught? And the whole business could have suffered if she had illegally served you?
What I am curious about is how did you notice you had slipped in a bottle of vodka once she had refused to serve you? Have you been there before? Seriously thought if your gonna do it realise it could quite easily ruin a night for your friends. Not to mention is pretty fecking scabby.

Depends on the club. The ones with glasses tend to become literal minefields of glass shards before the end of the night as people leave them on the ground to be kicked around, etc.
So often the cheaper clubs will use plastic cups :(

Losing the alcohol license might be the least of the owners problems. If I remember correctly, knowingly allowing a minor to drink alcohol could result in jail time in some jurisdictions (though I'm not certain about this; it would be worthwhile to look up what the current laws are).
Whoa, lil miss/mr police state.
Arresting minors who drink illegally hardly strikes me as being unduly authoritarian. Alcohol can have some nasty effects on the human body.

Yes, this is the government argument that often pisses me off, i shouldn’t smoke/tobacco/pot ect or drink alcohol, because its bad for me and because I’m stupid and cant make my own decisions i should be stopped from doing so, Yeah i don’t like seeing 15 year olds in pub either(although that’s a bit hypocritical of me seeing as I did it), simply because imo it ruins your childhood (there should be at least a short time in your life, when your don’t have to really on the juice to keep your going from week to week)
Hell i want to drink, the only reason i don’t smoke tobacco is because hell i don’t like the taste, and yeah i want to do these things knowing ill die at 50, shit everyone’s got to die of something id rather go at 50 while im still on top of my game than senile and crapping my self at 80.

Underage drinking is not illegal, selling alcohol to those underage is however illegal: the threat of arrest was spurious, unless the landlady was going to claim that Tink was drunk and disorderly or drunk and incapable. Ironically enough it would be illegal for tink to carry the Vodka outside on the street, but not to have it on her person inside the pub...
yep, that's right, sweet innocent little Tinky nearly got into trouble in Morcambe
Poor TInk... :(
The landlady was probably afraid someone would think she'd sold you the vodka. But I doubt it would have been legal for her to hand you over to the police.
Still, the important thing is you weren't arrested, and now it's just something you can have fun telling people about. :p

if the place had been raided and you had been caught drinking on the premisis the landlady would not only have lost her licence (not to mention her business and probably her home as most publicans live on site) but would also have been prosecuted aswell - she would have been fined heavily and ended up with a criminal record because of your actions

She was bullshitting you, to put it mildly: as landlady she has the right to refuse you service for just about any reason or to have you removed from the premises, but commanding patrons to empty their bags is well beyond her authority.
You're right, she should have called the Police and had them do it.
She is lucky that she did it so it didn't have to come to that.

Oh, for goodness' sake, leave her alone! She hasn't committed a crime. I'm not saying all she did was right, but I can understand her wanting to just tell people and have a bit of a laugh about it, and some of you are bashing her as if she were a criminal. Plus, that landlady threatened her with the police when she had no right to do so.

Yeah, pointing out the consequences of ones actions is rarely considered a "fun" thing to do...
But if a person doesn't consider them before such action, they may just "have" to consider them sometime during or after them.

No. But owners tend to get pissy about bringing drinks into their businesses (this includes non-alcoholic drink too btw)

It isn't a crime to drink underage here, unless Tink was shit faced then she was within the law.
Selling alcohol to a minor is illegal though.

yep, that's right, sweet innocent little Tinky nearly got into trouble in Morcambe

Something about the Law in these matters you don't understand?
I would say she was lucky the Police were not called or she would have found out just how many Laws she did in fact break.
For one thing, I don't believe it's illegal for an under-age person to consume alcohol in the UK, it's illegal for people to sell it to them, though I may be wrong. In any case, no, bringing alcohol into a club is most definitely not a crime. At the very most, a slight infringement of the law. Doesn't mean it's right, but stop blowing it out of all proportion.
For another thing, what exactly are you implying by "she would have found out just how many Laws she did in fact break"?
Lastly, several people have already pointed out to her what they thought of her actions. The point has been made. There's no need to bash her with it again and again. You're making it sound as though she did something terrible! You've made your point (needlessly, since others had made it for you before), now if you have any decency in you just leave her alone.

If she searched your bag she can't do a thing to you. In britain for definate and I'm pretty sure US too, it classes as an illegal search. The police are able to legally perform searches but the general public is not, including security guards. They're allowed to detain you until police arrive, of course, but if they search your bags and find an item it cannot be used as evidence because they could have planted it

That one, the Law was broken by her being a minor in possession. Two, she was consuming Alcohol in a public place not intended for such consumption (perhaps, we still don't know). Three, there was likely a Law broken in her obtaining the Alcohol...
Shall we see if there were any others?
For instance, did she supply any to someone else who should not have been consuming?

Actually, if the "club" is non-Alcoholic it is in fact against the Law to bring Alcohol in, even if you are "of age".
Maybe in the US, but this was Morcombe. Slight difference.
The proprietor does have the right to bar you or refuse to serve you though. But it isn't illegal to bring alcohol in (even if it is against the house rules)
In Public, yes it is. It is even against the Law for a person "of age" to consume Alcohol in Public places or in any privately owned businesses that don't have Alcohol licenses.
Alcohol licenses allow the proprietor to sell alcohol to anyone above a certain age (18+ for most drink, 16+ for cider bizarrely and 14+ if a whole load of requirements are fulfiled). Alcohol licences have no relevence to someone that brings alcohol from outside (and since it was in a bottle, it was clearly from outside).
Underage drinking laws apply to those that sell alcohol, not to the underaged. If a policeman finds a minor with alcohol and thinks they indend to drink it the most they can do is force them to pour it away. Although I think some more urban local authorities are applying more authoritarian policies.

I didn't say there was one. I pointed out that what she did wasn't a crime. Perhaps you are not aware that there a various levels of severity in law-breaking? A minor infringement such as that is not, by any stretch of the imagination, a "crime".
Besides, it has yet to be proven to me that she was breaking any laws. Merely drinking alcohol is not illegal, except in very specific cases.
Three, there was likely a Law broken in her obtaining the Alcohol...
Assuming quite a lot here, aren't you? If somebody gave her the vodka, she got it legally. If someone sold it to her, then that person was breaking the law, but TInk herself was not. In any case, she was not breaking any laws!
Shall we see if there were any others?
For instance, did she supply any to someone else who should not have been consuming?
Are you just out to be nasty to her, or what?
Even if she did so, that would have been perfectly legal, assuming she didn't charge them for it. Which, I think it's safe to assume, she did not.
Don't let them make you feel bad about yourself, TInk. There's no reason to. Besides, that landlady was just trying to scare you; she had no right to do what she did, and legally she was far more in the wrong than you.

In the U.S. it is the opposite...
You are only allowed to drink Alcohol in Public places that are designated "for" Alcohol, and you have to either have a license for businesses to do it all the time or a permit for one-time events, and the area itself has to be cordoned off from the general Public.
But again, I am unaware of the Laws in the UK and am not trying to suggest in any way that I do.

Ah, fair enough: the US and the UK have very different licensing laws. I was working through the thread, and hadn't got to post #111 yet, so I hadn't noticed you had made this error.
For the record i was about to make this post, which I'll make here, if only as a piece of information:
That one, the Law was broken by her being a minor in possession.
Not against the law: the police have a right to confiscate alcohol from underage drinkers who are drinking in public places and causing disorder. (Confiscation of Alcohol (Young Persons) Act, 1997). It is in fact legal for a child as young as five to drink alcohol, and even younger than that in cases of medical treatment or sickness. (Children Act 1908).
Two, she was consuming Alcohol in a public place not intended for such consumption (perhaps, we still don't know).
Nope: she was drinking alcohol on licensed premises.
Three, there was likely a Law broken in her obtaining the Alcohol...
Not necessarilly: it would be perfectly legal for Tink's parents to buy alcohol for her to consume, provided she does not do it in a manner or place which would contravene other laws.

Kellarly
30-03-2005, 12:37
well apparently it wasn't actually illegal
Well you are over 16 in a bar - Not illegal
You are under 18 drinking spirits on a licensed premises - Illegal
The person who bought it for you despite being 18 was buying it for you - Also illegal on that premises (not sure about if you did it in your own home though)
And if you smuggled it in and didn't buy it in the actual bar then they can turf you out anyways....
