Yeah that kind of suprized me too ... kind of deserving for her geting sue'd when she did the same to him to get child support out of him

i agree that he shouldnt have to pay child support etc, he didnt even have sex with her, but to sue for your sperm? taking it a bit far...

I'm afraid I agree with the court - he voluntarily donated the sperm to her (via orgasm). I don't blame him for not liking what she has done with his gift though - it's a low blow that she is now suing him for child support when the sexual act that he participated in does not normally lead to pregnancy.

Let that be a reminder to men to wear condoms and dispose of them personally - even if you're just having oral sex.

Edit: I don't believe she has a case for child support. Just in case you thought that from what I said above.

Well...it depends on the amount of contact she is expecting from him...I mean, the kid is 5 now? Which means he's probably been paying child support for a while...could he get out of paying child support any other way, I wonder? I also try to reverse the case (difficult)...what if he had impregnated her without her consent or knowledge (while asleep, passed out or whatever)...let's say he didn't even have intercourse with her, just artificial insemination...wouldn't that also be monstrous? I'm sure he'd get slapped with some pretty heavy charges for that...

Also, he has to explain to any woman he gets into a relationship why he has a child already, even though he didn't want one, or get one by accident (since this was deliberate impregnation on one party's part). That's got to be a bit awkward. Also, as a parent, I would be really upset to have my power over bearing children when I choose to taken away. Just because the man doesn't have to bear the child himself, doesn't mean that child isn't a part of him...a part that has been stolen in a really weird way.

One friend of mine had to spend over $700.00 (of his own money) for a paternity test only to prove that in fact his next door neighbor was the real daddy. Do you think his cheating bitch ex had to repay him any of that money? No! Even though she sued him for child support knowing damn well the kid wasn't his!

That's the point. She hasn't called him a liar. I bet there's a good reason for that. Don't be so quick to think that only men can behave in a shady underhanded manner when it comes to pregnancies. Just watch some of those "who's the daddy" paternity episodes of Jenny Jones or Montel etc etc... They usually work out about 50/50.

No, it's pretty clear that he voluntarily had sex with her and voluntarily ejaculated.

If she did do what he claimed, it's definitely bad, but it's not the same thing as rape. No one forced him to have sex with her.

1: the kid was born 2 months ahead of supposed schedual but the doctor said the kid was born fully developed, not premature.

3:Rape is about power. You can exert a lot of power on some one by taking away their right to choose who they procreate with. You can exert more power by moantarily fining them for the pregnancy. And exert even more power when you take away their right to have contact with their child.

Legal hell, yes, but let's not even imagine the physical hell the woman would be stuck with if she chose to bear the child (especially if she lived somewhere where abortion is illegal).

I'd say the guy has a case. I don't know what the law is, but I don't believe that sperm-donors have to pay child-support. Since the woman clearly artificially inseminated herself, it would make him the donor and thus free of child-support responsibilities. I think he has every right to sue a)because of all the child-support he paid and b)that bitch pulled one hell of a nasty trick on him and he deserves compensation.
