yup, the cheif justice of the supreme court is sitting out two weeks of oral arguments due to health issues. I think he may soon retire for good. Missing the most important part of the trial isn't a good way to make a decent judgement on the case.

Screw that. With Bush in the white house Rhenquist should tough it out for the good of the nation. Hell, if he dies, just sit him up there and use strings or something to make it look like he's moving.

Well, Rehnquist, while certainly better than some others has been an unpredictable vote. He's gone both ways just as several others has done. Personally, I would like to see a younger justice come into power, maybe it would bring some change in the mood of the supreme court towards a more liberal (and in my eyes) better change.

But isn't unpredictibility a good thing? To me, it's better that a judge not follow a party line (any party line of whatever political bent) just to follow the party line. Aren't judges supposed to consider points of law, reference them to the Constitution, precedent, human rights laws, etc and make their rulings accordingly? I thought their personal beliefs weren't supposed to colour their judgements. In an ideal world, anyway.

I don't necessarily need somebody uber-liberal in there. Just not an anti-civil -rights-I-love-only-business-and-the-christian-church-whacko. Scalia is a scary fellow. Gonzales or someone like him might be even scarier.

Is O'Connor, the Regean appointed Republican Justice who saved Roe v. Wade in Planned Parenthood v. Casey a partisan hack? How about the Bush appointed Republican Justice Souter, one of the more liberal members of the Court? Rehnquist, Scalia, and most of all Thomas however are all longtime residents of Hackistan.
