TORONTO (CP) - The federal government has "abandoned" a Canadian teenager being held as an "enemy combatant" at a U.S. prison camp in Guantanamo Bay, Cuba, broadening a shroud of secrecy that has failed to ensure his humane treatment for nearly three years, his legal team said Tuesday

The United States and France have agreed to repatriate the last three French citizens being held prisoner in the US military base of Guantanamo in Cuba, various sources told AFP.
The agreement in principle was given before US Secretary of State Condoleezza Rice was to meet French President Jacques Chirac in Paris later Tuesday.

Plenty of people have been locked up in Guantanamo for no reason. The U.S. has been slowly releasing the occasional person from Guantanamo for a while now, and it would seem that the French nationals mentioned in the other article as being held there were held there for nothing (unless the article is not telling the whole story).

GITMO detainee's claims dismissed by UK

CLAIMS made yesterday by a former Guantanamo Bay detainee that a British intelligence officer interrogated him before he was handed to United States authorities have been dismissed by the Home Secretary, Charles Clarke.
Martin Mubanga, who spent three years as a detainee in the notorious prison before his release last month, claimed he was interrogated by a British spy in Zambia before he was arrested and sent to Guantanamo Bay.
But yesterday Mr Clarke said he would not launch an investigation into the allegations, which include charges of torture.

The military is far from infalliable, so it is entirly likely that he is innocent. You know, innocent 'till proven guilty, and the fact that no trial has been conducted, shows that he is innocent.

The principle that there is a presumption of innocence in favor of the accused is the undoubted law, axiomatic and elementary, and its enforcement lies at the foundation of the administration of our criminal law.... (156 U.S. 432, 454)
Plus the 5th Amendment says
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or an indictment by a Grand Jury
So don't try to claim that because they are not US citizens, they are not entitled to a trial.

Torture is a word which is thrown around quite loosely these days and hardly encompasses most of the actions being used.
And yes they were captured at war.. a pitty they did not recognize themselves as offical army soliders employed by the state.. then perhaps they would be prived to the laws given to them by the Geneva convention as prisoners of war...

And you would know this due to the full and public trials, oh no you wouldnt because there have not been any.
If what you say is true can you explain why two British citizens were held due to being in a terrorist training camp in the M.E. on particular dates when they were video taped on those days in Britain....wow they must be clever to be two places at once....funny how just as a law suite was about to be heard in a US court, they were released, funny how the British authorities didnt choose to hold them, or charge them with anything...funny how many people have been released after a couple of years and apparently inhumane treatment, and absolutely no charges...but of course everyone is guilty untill proven innocent, even when no one has actually charged them with anything.
I sincerely hope if you ever come to understand how wrong this is, it isnt because you or a loved one of yours is on the receiving end. I know you think it wont ever happen to you, because you for instance were never in a terrorist training camp, but you need to realise that even video footage proving you were elsewhere on the dates in question wont secure you a speedy release...apparently it's now 'guilty even after you prove yourself innocent'...

HOUSTON (Reuters) - A U.S. Air Force pilot drew a sharp reprimand and a fine on Tuesday, but no confinement for mistakenly killing four Canadian soldiers in a 2002 bombing raid in southern Afghanistan (news - web sites).
Following a hearing last week, F-16 fighter pilot Maj. Harry Schmidt was found guilty of dereliction of duty and ordered to forfeit $5,672 in pay, the Air Force said.
"You acted shamefully on April 17, 2002 over Tarnak Farms, Afghanistan, exhibiting arrogance and a lack of flight discipline," Lt. Gen. Bruce Carlson, 8th Air Force Commander at Barksdale Air Force Base in Louisiana, said in a written reprimand.
"The victims of your callous misbehavior were from one of our staunch allies in Operation Enduring Freedom and were your comrades-in-arms."
Schmidt, 38, could have been confined to quarters for up to 30 days or limited in his movements for up to 60 days for the offense.
His lawyer, Charles Gittins, said in an e-mail Schmidt was "contemplating" an appeal of Carlson's findings.
"We ... are shocked by the fact that General Carlson found Harry guilty of an offense of which he was never charged: the unpremeditated murder of the four Canadians," he said.
He blamed poor leadership for the deaths and said the Air Force, by punishing Schmidt, had "protected the criminal negligence of its general officer corps."
Schmidt said in a hearing last year that he dropped a 500-pound (225 kilo) bomb on the Canadians because he thought their night-time anti-tank maneuver was enemy fire. No one had informed him that military practice sessions would be held that night, he said.
Despite instructions to hold fire, Schmidt told air controllers and flight leader Maj. William Umbach, flying in a separate F-16, he was "rolling in, in self defense" and dropped the bomb.
Four Canadians in Princess Patricia's Canadian Light Infantry unit died and eight were wounded in the incident that strained U.S.-Canadian relations.
"You used the inherent right of self-defense to wage your own war," Carlson charged in the reprimand.
Schmidt and Umbach apologized last year but blamed the "fog of war" and the Air Force's practice of giving pilots amphetamines to stay alert.
Schmidt's punishment came after a nonjudicial hearing before Carlson on July 1. He had previously insisted on a full-blown military trial, but dropped the demand in June.
Originally, he was charged with manslaughter and aggravated assault, but the charges were reduced to dereliction of duty.
Umbach accepted in June 2003 a letter of reprimand and was allowed to retire.
Schmidt has until July 12 to appeal Carlson's decision, an Air Force spokeswoman said.
