U.S. Judge: Guantanamo tribunals illegal

The Bush administration suffered a legal setback over its conduct of the war on terror yesterday when a US federal judge ruled that the special military tribunals at Guantánamo Bay were unlawful.

"[The judge] is saying that the rule of law in this country cannot be disregarded by executive fiat - despite what this administration might want."

...

Judge Joyce Hens Green ruled that prisoners were entitled to the protection of the US constitution and the Geneva convention even during the war on terror.

"Although this nation unquestionably must take strong action under the leadership of the commander in chief to protect itself against enormous and unprecedented threats, that necessity cannot negate the existence of the most basic fundamental rights for which the people of this country have fought and died for well over two hundred years," the judge wrote.

American Newspapers...LOL...where you wanna look at the NYTimes?
dont waste your time..The NYT (like most american media) is likely to minimize(smoke it to the 8th page) this kind of news...

I suggest picking up a copy of tomorrow's paper and checking.

Bear in mind that the New York Times is the best news organization in the US, so if anyone gave the story the prominence that it deserves it would be the Times.

I guess the apple really doesn't fall far from the tree. Maybe next we'll actually move to a parliament system and develope a decently leftist government. But thats not too likely.

I bet many of those who voted for bush aren't the slavering war racist mongering stereotypes that they are made out to be, but genuine decent people who fell for the hype and propoganda.

Or maybe just that it doesn't have a shiny, eye catching picture like the Michael Jackson trial (foxnews) or a picture with guns (cnn, cbs.) There's a difference between media control and marketing. And anyways, with CNN and Fox, it's right on top of the headlines sections.

This is a very interesting topic. The USA has always abided by the Geneva convention even when the enemy hasn't ex: Jermany and Japan in WWII and now Mid-Eastern terrorists. This topic has probably come up many times in the past with one side of the argument being: We should keep using the Geneva convention as a guideline to how to treat POWs and the other side being an Eye for an Eye: the enemy tortures and beheads our POWs, we should use more violence against their POWs

My opinion is that we realy arent doing shiz to enemy POWs compared to what the enemy is doing to the US's POWs

FYI: Canada AND the UK are currently detaining individuals for the same reason as the US.

indeed and the house of lords has now said that they are being kept unlawfully so they will be realeased and at leatswe havent heard stories from those prisoners about how they were abused

The real problem is, IF there is no evidence(or not enough), then do you let a suspected terrorist go?

Canada is currently holding a person that was convicted of terrorism in Egypt. Canada isn't going to deport this person(back to Egypt) because he may be tortured there. So now what do they do? Detain him indefinitely? Let him go free?? Deport him to Egypt, anyway?
