I thought this was funny, According to the AP (http://www.salon.com/news/wire/2004/12/23/festivus/index.html), a local church group put a nativity scene up on public property in Bartow, Florida, with the permission of the Polk County Commission with the condition that any other religious or secular groups could put up holiday displays. The church agreed--which is a big plus in my eyes for the church--and sure enough, other displays popped up, including one for Zoroastrianism and one for Festivus.
A local ACLU member--and the article didn't say whether he was speaking for himself or for the ACLU, so I imagine he's on his own on this one--objected to the display. (The ACLU's standard position is that there's nothing with religious displays as long as all religious and secular groups are given the opportunity to do the same.) There's no mention of legal action, which is another reason why I think this guy is speaking only for himself.
Unfortunately for the display, all that's there for Festivus is a sign--no aluminum pole. I mean really--how hard is it to find an aluminum pole and stick it in the ground? :D
