It is my duty to inform you that the Chief Justice of the US Supreme Court is in the hospital being treated for thyroid Cancer.

My thoughts and prayers go out to him and his family and I hope he makes a full recovery.

Me too. *cynicism* Except I hope that he returns to Court way after the election so he can't help hand it to Bush *end cynicism*

It would be 4 and 4!

There are nine justices on SCOTUS not seven!

What's wrong with Clarence Thomas?
He's black!

...

actually, he is the scariest fucking conservative I have ever seen get such a high position, he denies separation of church and state, he is even more conservative than Scalia, if that's possible. I don't know how this guy got approved by the Senate. Of course, he's probably your hero.

Dude, I don't trust the US Supreme Court wether they are conservative or not.

God has been helping kerry alot recently, giving messages to america about His opinion of george bush (florida storms, mt st helen, et c.)

Maybe after kerry wins god will strike down all the conservatives so that we can have an enlightened and honest supreme court.

While a clerk for Justice Robert Jackson, our current Chief Justice wrote a brief arguing that Plessy v. Ferguson (Separate but equal) was the correct interpretation of the US Constitution. Later, while facing questions about the memo at his confirmation hearings, he lied about his intent. A direct quote from his memo:

“I realize that it is an unpopular and unhumanitarian position, for which I have been excoriated by my ‘liberal’ colleagues, but I think Plessy v. Ferguson was right and should be reaffirmed.”

During the period of 1958 to 1962, Rehnquist was director of the Republican Party's Operation Eagle Eye. He and his evil associates actually went to polling places in black neighborhoods to intimidate the local citizens into not voting. Using arcane and racist laws designed to block blacks from voting, Rehnquist grilled prospective voters, for hours sometimes, "to see if they passed muster on Arizona's literacy clause." He physically intimidated potential voters under the guise of officialdom and held up those who would not be intimidated. And then he again lied about his activities when facing confirmation. :sniper:

William Rehnquist is a racist and a fascist. I don't hope he dies from cancer, but if it's meant to be I can't imagine many people more deserving than he. Karma catches up to you.

I don't. Judges should not be conservative or liberal. If you can easily determine their personal opinions, they are bad judges. Judges should simply interpret the law.

In the US, the legislative simply dictates the judicative what it may judge.

What's the difference to the Supreme Court if he dies or retires because of his health??

As it is, there are only 2 Democrats sitting right now. If Bush wins the election and appoints another conservative nothing changes. If Kerry wins and appoints a liberal, there is some change, but not much.

What would be interesting is if Kerry won and appointed a new liberal justice....I wonder who he would appoint as Chief Justice? Would he think of appointing Ruth Bader Ginsberg? She's the liberal that's been on the bench the longest. That would be interesting...I'm all for that :)

If only it was that easy. Politicians play this game, they know a conservative or a liberal judge from their record. They try to pack the courts. They basically turn the courts into more partisan Congresses.

Do you have a copy of the brief/bench memo ? I'd be interested to see what it argued.

Wrong!

We have a seperate Judicial Branch! The Judicial Branch interprets the law or declares it constitutional or unconstitutional. All the legislative branch does is pass laws.

It is up to the Judicial Branch to decide if the laws passed are illegal or not. If they are legal, and there is a question on interpretation, the judicial branch interprets the law.

The problem lies in the fact that each circuit can interpret it differently. If that is the case, the US Supreme Court steps in and decides the issues.

I will agree with this statement. It shouldn't be this way but unfortunately it is.

I would have preferred Chief Justice Robert Bork. Unfortunately, the same sort of human scum that consider Rehnquist to be "evil" and "fascist" are intent on using to courts to usurp the democratic process.

Present company excluded, of course. It's why such people are so intent on demonizing President Bush - the next president will be responsible for replacing Rehnquist, the most conservative judge on the Supreme Court, and likely one or two others. This is a critical election for the Left for that reason alone, and they have no intention of losing - regardless of how the popular vote comes out.

You know, I think Pat Robertsion's Jesus magic has faulty aim or something. He prayed that Virginia be spared from a certain hurricaine and it was hit harder than any state on the Easter Seaboard. He prayed that hurricaines on their way to hit Disney World do so during a gay pride rally and they changed course to hit a bunch of Churches. He prays for God to "move against" two Supreme Court justices who voted to overturn Sodomy laws and then God goes and smites one of the 3 who voted to uphold them. :headbang:

If I were Pat I think I'd switch to that "pray for the opposite" strategy that pessimistic grade-schoolers use.
