Arizona Libertarian Party Moves To Prevent Final U.S. Presidential Debate

The Arizona Libertarian Party has filed a "Civil Complaint" against the Arizona State University and the Commission on Presidential Debates.

In the complaint, the Arizona Libertarian Party claims "...that ASU and the CPD are acting in violation of the 'equal protection of the laws' portion of the Fourteenth Amendment of the US Constitution. The complaint also states that ASU and other governmental bodies are spending money and using other public resources in a partisan political manner in violation of Article 4, Section 19-13 and Article 9, Section 7 of the Arizona Constitution."

"The hearing is scheduled for 9:00AM, October 12, 2004 in Room 814 of the East Court Building of the Maricopa County (Arizona) Superior Court. The hearing is scheduled to be no longer than one hour, with one half hour alloted to each side to make their arguments."

If the Arizona Libertarian Party is successful in making its case, the judge can issue an injunction, preventing the third CPD sponsored U.S. Presidential Debate from occuring. 1. No restraining order, because of the doctrine of latches, and that there appears to be sufficient public purpose for this debate.

2. The Plaintiffs may continue to pursue damages for any violations of the constitutional provisions.

In summary, we couldn’t stop the debates or get Badnarik in, but we may still be able to hold them accountable through damages."

Dammit, I go to ASU, and I've been waiting for the debate! I respect Badnarik and the Libertarians in specific, and the plight of third-party candidates in general, but I seriously hope this just remains a stunt, and does not actually affect the debate.

I go to ASU as well and I absolutely loathe libertarians.

Imbeciles want to ruin our debate fun! Rotten anarchist ratbastards!

I WANT massive parking hassles and I WANT swarms of media and I want the whole thing to be a zoo, it will be FUN~!!

And maybe george w bush will slip and fall into a cactus, and that would just plain be grand~!
(though I dont believe gammage has any cacti 8( )

Judge Henry Kennedy Jr. noted that in 2000 the debate commission gave security guards 'facebooks' with pictures of third-party candidates and instructed the guards to prevent those in the photos from entering the debate venues, even with valid audience tickets.
