Actually, it's public domain, so anybody can use it for commercial or private use. It's like showing an American flag in a commercial for a Toyota truck. Not a big deal.

I think you'd have a better argument by asking about the usage of the word "Olympics" in recent Bush ads. The USOC gained exclusive rights by Congress in 1999 to the word "olympic" and any derivatives. They also have exclusive rights to the Olympic symbol of rings. The Congressional Act also says this about the USOC: "shall be nonpolitical and may not promote the candidacy of an individual seeking public office."

Now if it was a party that had never gotten a canidate into the the rank of president, then there may be an argument. Just like when you serve in the military, if you serve the president you recieve a presidential seal of service that you wear on your uniform.
You could then go start a website if you wanted with that seal as your official icon(anyone can). Since the deomocrats and repubs have had a president from thier party, they have a complete right to try to persuade people through these means. I would be very suprised to see that the democrats have not done this very thing in the past. Its just one of those things that each party uses to "rally their troops" to say. Kind of like how both party's try to wrap themselves in the flag more than the other. Its exploitation, but its up to you to decide if its bad or good exploitation.

not sure about the seal, but as per the american-flag-in-advertising thing:
The 1942 Flag Act, which is the basis for most flag-desecration legislation, explicitly forbids the use of the flag in any advertising or as part of any business logo. some other points:
Display the flag only during daylight in good weather. Take it down when it gets dark or if it starts to rain or snow. You may display it at night in good weather if it is lighted. (all those made-in-china-flags in front of so many houses, on mailboxes and car antennas, not ok.)
Do not let the flag touch the ground, water, BUILDINGS, or MERCHANDISE. Do not carry the flag in a parade by the edges (flat) or attached to a pole along the top. (catch that? not only was the megaflag near ground zero not ok, NONE of the T-shirts, baseball caps, postcards or any of that crap is ok)
The flag should not be draped on a car or podium. Instead use red, white, and blue bunting with the blue at the top. (pretty sure all those flags i've seen in the back windows/hanging over the back seats of cars fall in this category of "desecration")
When displayed on a wall, the flag's canton should be on the left as you view it. (but wait, aren't walls parts of buildings? ah well... either way, all major buslines everywhere since 9/11/01 have been displaying the flag stickers on their right sides in a disrespectful manner. not to mention that the flags are STICKERS, therefore MERCHANDISE (also see below)
Do not use the flag for advertizing a product and do not print or embroider the flag on anything designed for temporary use and discard. (stickers and the cheapo antenna-flags fall in this category, as do SO many billboards, print and TV ads, and again, tons of cheap patriotic merchandise, and all those plasti-board placards and shit.)
When the flag is no longer fit for duty (threadbare, faded, torn, or dirty) it should be destroyed in a dignified manner (preferably by burning).
(OH NO! but burning flags is UNPATRIOTIC and banned by most desecration legislation. no wait, only the thoughts in your head while you do it are violating the code or legislation.)
also marking the flag in ANY WAY (whether it's with poo or with "god bless america") is TOTALLY UNACCEPTABLE
funny how all them jingoistic ol' patrioticapitalists are desecrating the flag so very much.

The cufflinks in question are in the section of the store known as "Democratic Gifts" (see this page (http://www.campaignsource.com/index.htm), top left. The store itself is the one linked to by www.democrats.org, the official website of the DNC. Honestly, I can't believe you're actually arguing that there's a difference between the Democrats selling merchandise with the Great Seal on it, and Republicans selling merchandise with the Great Seal on it.
