Well, I was watching his first court appearance (as I imagine most of you were) and he stated his name as SH, President of Iraq. When the judge said that that was no longer his title he inquired into what authority they had to strip him. I cannot recall what his aanswer was (please tell me if you do) but it got me thinking..

What authroty did they have to strip him of his title? They were the invading nation, and they could do that, so basically the answer is "Because we have invaded you (not under the UN, but unilaterally) and we say so".

So, technically, unless the US have a better answer, Saddam, athough a prisoner and stripped of his power, is still, sort of, President of Iraq...

Well, considering that the CIA pretty much gave Hussein his title, I would say that he should consider himself fired by his employer (the United States).

Then every act that Saddam did is US's fault if they can fire him.

But its true, he has immunity to those trials legally. The "new govt" chose to ignore this law to punish him.
So he is and will remsin the president of the Iraqi people.

Hmm. They might have, they gave him some nice "employee gifts" but fired him in '91. He just hung around. (Like David Brent from The Office. You may know this if you are from the UK)

Since the US had no authority to install Hussein, they have no authority to take him away from his "position". Hussein can only be tried in front of the ICJ/ICC.
