Teddy Kennedy Fails to Oust Judge Pryor
Sen. Teddy Kennedy of course never objected to the recess appointments made by Bill Clinton, but he and other Dems threw conniption fits when President Bush did the same thing. Now, however, the Bostonian's attempt to topple one of Bush's appointees has been toppled.
Even after Bush caved to obstructionist Democrats and gave up his constitutional power to make recess appointments, Kennedy pursued a lawsuit against him in the 11th U.S. Circuit of Appeals.
Kennedy based his attack against Judge Bill Pryor on a technicality. He claimed that the recess appointment was not a recess appointment because supposedly the chamber was merely adjourned.
Temperamental Teddy lost on a technicality of his own. The appeals court ruled today in Atlanta that he failed to file his challenge before the deadline April 28.
