Resolution #9 clearly states that torture is a ‘crime against humanity’. And provides a list of what torture is:

“an act of intentionally inflicting pain, severe discomfort or suffering on a person for the purposes of intimidation, coercion, personal punishment or interrogation, or to extract information, confession or concession to demands from them or any other person, where committed with the approval or assistance of a government official or person acting in such capacity.

Such acts include, but are not limited to:
-Physical, sexual, or psychological abuse,
-Forced maintenance of physically uncomfortable positions, such as stress positions or forced standing,
-Sensory deprivation, such as prolonged confinement to dark quarters and or use of a hood during interrogation,
-Subjection to intrusive noise, such as noise that is continuous or excessively loud,
-Sleep deprivation,
-Deprivation of adequate food and drink,
-Denial of necessary medical care,
-Denial of right to religious observance,
-Attempts to reduce physical or mental capacity, even where not causing pain or severe discomfort or suffering.”

This list is sufficient for the purposes of the World Assembly

However, resolution #9 also states:

“Evidence obtained by torture shall be inadmissible in legal proceedings, except as evidence against persons accused of having obtained it by torture.”

And implies that torture shall not be used in any form by any government.

This resolution states that torture shall be allowed against terrorists, both foreign and domestic, ONLY if national or international security is threatened.

This resolution also states that if the above mentioned should happen, any and all evidence obtained by torture methods shall be admissible in federal courts of law.

This proposal has been submitted by the Kazekage no Gaara, with his high hopes for its acceptance.

If you mean that your proposed repeal of Resolution #9 has been submitted with these clauses included then it is illegal and will probably be removed from the list when a Mod notices it: A repeal can only repeal, not modify...

Your argument seems to be 'this is a great idea, except for people we don't like'. Exactly who did you think the resolution was supposed to protect? Scripture tells us, 'What you do to the least of my brothers you do unto me'; and the Quodite humourist H.L. Womencken once remarked, 'The tough thing about freedom is having to defend sons of bitches'. We have no truck with terrorists, but they are, perhaps unfortunately, humans, and thus should fall within the protections of human rights resolutions.

I accept my resolution can be criticised on various grounds. If I had the opportunity, I would make some minor revisions to it. But your argument as it stands seems to completely ignore its point.
