Proposal : Definition of Terrorism

This proposal hereby defines a terrorist and terrorism.
The "Prevention of Terrorism" proposal did nothing to define such groups and individuals. It left ambiguous and up to the discretion of individual member states the definition of a terrorist.

The definition of a terrorist is hereby states-

1. An individual or group which conspires and commits grave acts of terrorism.

2. Terrorism is defined as -
(a) Unprovoked attacks by private groups (non-state actors) upon the population of a particular state or group of states to further a radical political, economic, or social agenda. These must be violent attacks or conspiracies to commit violent acts.
(b) Attacks upon government or private building using improvised explosive devices, chemical or conventional weapons with the intent to obtain a political means.

3. Excluded from the definition of terrorism is the following -
(a) Peaceful resistance groups (Environmental, Leftist, Marxist, Rightist, Libertarian, Anarchist, Animal Rights, etc.)
(b) Private security firms under contract with state or national governments
(c) Governments-in-exile
(d) Rebel groups within a various state seeking regime change through which violence is their last resort
(e) Political Parties which use non-violent means to achieve their goals (Terrorist organizations have been known to masquerade as political parties)
(f) Street gangs, organized crime groups, biker gangs and other domestic criminal organizations.
(g) Any military of any nation-state
(h) Regional or ethnic secessionist movements, non-violent or otherwise.

4. A terrorist group is hereby defined as -
(a) A non-state actor which meets no definition in section 3.
(b) A group which uses covert tactics and unconventional means including but not limited to car bombs, IEDs, dirty bombs, suicide bombers, and airplane hijackings to further a national or international political or economic agenda
(c) A group which takes direct responsibility for a terrorist attack or plot to commit a terrorist attack.
(d) A group which engages in warfare with a nation's military or private security contractor whom is not uniformed and posing as civilians. (With the exception of any groups in section 3)
(e) Any group which declares a holy war against a nation or allied bloc of nations (Radical religious fundamentalists)

5. A group need not be fully independent of state sponsorship to be considered a terrorist organization, however the group will not be run by any state. Any terrorist group under the direct command of a state is considered a military or intelligence organization and must be engaged as such.

This proposal attempts to strike a balance between the broad definition of the previous proposal and a weak law-enforcement-only approach to the problem of terrorism.

A proposal has to include more than a definition in order to be legal: This draft wouldn't even qualify as 'Mild' in strength.

Sigh... just wait for the Altan Steppes' proposal to come out; it's better if we work cooperatively on a single project. That, and I have the slightest confidence that Altan actually knows what he's doing.
