New Proposal: Ban Illegal Use of Drugs

The World Assembly,
REALIZING that recreational and illegal drug use is at an all-time high,
ACKNOWLEDGING that drugs are damaging to the human body and alters consciousness,
RECOGNIZING that prescription drugs are sold and used illegally for the same purpose,
CONCERNED that drug use leads to domestic violence, an increase in murders, and ever growing crime rates,
HEREBY:
1.) REQUIRES that all consequences/punishments shall be determined by the nation’s Federal Court with the evidence provided by the national authorities,
2.) ENABLES the national authorities to monitor all prescriptions and ensures that stringent laws are made so that they are prescribed to only those who need them,
3.) RECOMMENDS that background checks be used whenever a prescription be filled out to avoid giving drugs to addicts and dealers,
4.) AUTHORIZES the national authorities to monitor all suspected distributors and drug dealers and that those who are found handling drugs are immediately arrested,
5.) OFFICIALLY bans all illegal use of all prescription and illegal drugs.

the government of the emperor of urgench would like to remind the most highly esteemed ambassador for the great nation of R539 that this is not a national parliament, where this resolution would more properly be debated.
we have no laws banning the uses of any drugs by our citizens (and we are by no means the only nation like this) and would therefore see it as the grossest possible usurpation of our national parliament's authority were the w.a. to impose completely contrary statutes of this kind.
we and we suspect many other nations would resign the w.a. were this, confused and, we are genuinely sorry to say, quite poorly written resolution to be brought into force.

i agree with R539 it is very badly written and i also guess from your stance that civil rights within your country are extremly bad and if this is to go through to vote i shall resign my position within the WA in protest

This line is completely redundant. If a drug is already illegal then it is already banned. If it is not already illegal then it will not now be banned by your proposal. Thus, your proposal does nothing to outlaw recreational drugs (as I'm sure you are intending).

You are denying medicines to drug addicts?
On another point, you seem to be blaming recreational drugs for all life's woes. But this needn't be the case. Take the Netherlands for example where cannabis use is legal.

The Federation legalized drugs a long time ago (before we even formed a Federation, in fact). We're not likely to favor any international legislation concerning drug use, as we believe that to be a matter which should be left to individual nations to regulate (or not, as they please). The only legislation we might support is legislation which seeks to prevent states from exporting drugs to nations that have deemed them illegal. Even that, we think, could probably be best done in venues other than the WA.
As for this proposal:

What if a nation doesn't have a "federal court" or "supreme court" or whatever term you prefer to use? How do they resolve the matter then?

Nations are already free to do this, if they want.

We're okay with this clause, as it doesn't actually do anything.

As others have already pointed out, if something is illegal in a nation, it's already banned by that nation, making this clause redundant.

Salzland opposes this Resolution, if only because it attempts to ban "illegal" drugs, then provides no definition for what an illegal drug will be considered to be. Will this Resolution cover only "hard" drugs (such as heroin, cocaine, etcetera), include "soft"-er drugs (pot, etcetera) or even extend to some otherwise-legal controlled substances in the medical industry (opiates such as morphine, etcetera)?
Other objections include, but are not limited to, mandating that Courts decide punishments (sentencing guidelines should be determined by legislatures, with courts using these ranges to impose harsher/softer punishments as dictated by circumstances), vague wording (we are concerned with precisely how to limit prescription drugs to only those who "need" them, or in other words how to define "need"), etcetera.

R539 makes a strong point about illeagal drugs but if we completly illeaglize them it opens black markets in wich hightens the crime rate. so the way to fix this is by leagalizing them in one or two citys (like amsterdam) or by putting a severe penalty for using them such as death for anyone who is cuaght with a joint.
