Repeal: The Right to a Fair Trial

Understanding that the intended purpose of "The Right to a Fair Trial" is to provide fair trials,

Noting that the resolution fails to understand that the WA is composed of wildly divergent cultures in its description of a "Fair Trial",

Also noting that the resolution fails to take into account that certain nations have long-established non-jury judicial systems of unquestioned integrity,

Regretting that the resolution allows defendants to choose any person to represent them, despite the legal ramifications of possible conflicts of interest,

Further regretting that the resolution allows defendants any number of appeals they wish,

Noting that this flawed legislation bars a more effective resolution from passage,

Seeking the opportunity to introduce a more effective version of this resolution to the World Assembly,

The World Assembly hereby repeals "The Right to a Fair Trial".

So, time to get this out of the way. Narnian Council had a nice resolution (http://forums.jolt.co.uk/showpost.php?p=13601853&postcount=1) in the queue right behind the resolution we're talking about (http://www.safalra.com/other/nationstates/wa-resolution-browser/?resolution=3). The passage of the former led to the deletion of the latter for duplication.

I'd like to see the better resolution replace the passed one. In that vein, a repeal. Comments?

While the motivation behind the repeal may be based on bringing the better proposal to light, your actual repeal should only be based on the merits of the resolution. I think mentioning the other proposal would be unwise (and illegal?).

Wasn't unwise or illegal when I did the Metric System repeal. I fully intend(as I did then) to ensure a replacement is brought to vote, so it makes sense to point out that "hey there is a better resolution out there even if this goes away".

You may be surprised at how many times people message back concerned about the "gap" you're creating with your repeal. It's important to assuage those fears early.

I honestly don't have anything to comment on, other than to say that if this were submitted into the queue it would have our approval. I doubt it would pass if it even managed to come to a vote, unfortunately.

I dunno, I think it could have potential.
And if you think a resolution can't be repealed because so many people voted for it, that isn't necessarily true.
[OOC: "Max Barry Day" passed by a shockingly vast majority, and it was almost immediately repealed (there was one resolution between the original and the repeal because something else had made it into the queue).]

As I had given my approval to the NC proposal, I will gladly support this repeal.

OOC: Just a couple of minor quibbles _

1/. You've got a superfluous apostrophe in the second clause:

The correct form would be "in its description"...

2/. And shouldn't this clause Accepting that even as this legislation was passing, another more effective resolution existed, refer to the other, more effective idea as a 'proposal' rather than as a 'resolution'?

Go for it. It will give our nation a chance to obey the WA resolutions and have court cases. We stopped all our court cases and all accused were now free because we didn't want a jury trial, nor did we like to get hostilities with the WA-nations. We will support this repeal and we will spread the word to get more support.
