Proposal Suggestion (Feel free to steal) Medical Lawsuit Fairness

In today's day and age, medical malpractice lawsuits are commonplace. They can occur from unforseen events, unpredictable allergies, simple smears and smudges on printed or written paper, unreported symptoms, misleading symptoms, and others. Or, of course, a doctor making a mistake due to him not knowing something yet, ill will against a patient, taking what he believes is the best route, or a simple mistake.

I am not a member of the UN, but I've been thinking about this for a while.

Malpractice lawsuits have been used to give money to people purposely sabotaging themselves to get quick money, and act as a major deterrent for most doctors to preform needed drastic measures (Though, the argument could be made that malpractice lawsuits can deter TOO drastic measures). Because of the threat of lawsuits, most doctors charge more for their services.

My suggestion is this: Once the doctor, nurses, and patient (If they are alive) fully report on the entire situation, the information is anonymatized and given to a team of 5-10 randomly selected doctors within that country, asking if there are any glaring mistakes. If the majority of the doctors- 75% or higher- feel that this was the path any doctor would have taken- It is significant proof that the doctor on trial has done nothing more than followed regulations and procedures.

Any sort of corruption would be hard to do; though, choosing 5-10 completely competent doctors might be a tad challenging.

Why you even bothered to think a proposal when the UN decisions do not affect your nation in any way?
"Stealing" the proposal or with a simpler term, your ideas for a proposal?
You can simply discuss it but i don't understand why are you giving time to this when you are a non UN member?

Also, it says right here in the rules:

'Proposal Stealing

If it can be proven that you've simply copy and pasted somebody else's Proposal and submitted it as your own, it'll be deleted, and you may be ejected from the UN as well.'

I said it's okay to take the idea, so it's not exactly stealing, is it?

I'm not this idea is really international enough for the UN to concern itself with, particularly because not every nation necessarily has a highly litigation-prone legal system.

One idea might be a Good Samaritan Law for medical personnel: those who render vital aid in countries where they are not licensed to practice medicine could be immune from prosecution for such. That's an idea we've suggested in the past, and might be one reasonable way of dealing with medical malpractice lawsuits in an international body.

i don't understand why are you giving time to this when you are a non UN member?

Lots of people enjoy the debate in UN without being UN members. It's certainly not a requirement.

Ok. There's an old thread (http://z15.invisionfree.com/Reclamation/index.php?showtopic=186&hl=) about the idea on Reclamation, but it contains more musings than anything substantive. It's a proposal idea I like, but I don't personally have time for it right now, so I'd be pleased to see someone else at least sound it out for plausibility.

Being an old volunteer firefighter from way back before my politicking started I'll take it. :D I'll start to flesh it out and put it up on Reclamation to be picked of nits.

As far as we're concerned, there's absolutely nothing wrong with a non-member sharing an idea with the members of the Assembly. In fact, we'd like to thank the person from Sciencicalness for the attempt to contribute to the organization.
