[DRAFT] Repeal "Common Sense II"

This is a rough draft:

Whereby UN Resolution #30 "Common Sense II" shall be struck out and rendered null and void.

The United Nations,

ACKNOWLEDGES the good intent of the resolution in stopping frivolous lawsuits;

CONCERNED by the term "idiotic" , particularly in terms of those suffering from movement or coordination disorders, or disabilities

UNSETTLED by questionable issues in the points mentioned in the resolution, including:

Occasions where necessary safety equipment is not supplied by employers, who then order employees to continue without it;
Occasions where complex tools/machinery are supplied without instructions, or with misleading or incorrect instructions;
Occasions where harmful products are improperly or misleadingly labelled or advertised;


DISTURBED by the idea that disproportionate response from civilians to criminals cannot be redressed;

DISTURBED by the protection provided by the resolution towards traps or other items designed specifically to harm or kill intruders or criminals

THEREFORE repeals UN Resolution #30 "Common Sense II"

Repealing this would seem to be - ahem - common sense for many nations on the forum, but I really don't know how much support you'll get from the General Assembly. I'd predict that a good repeal would stand a good chance of passing.

I would advise that this go in a direction of general support of tort reform (stopping frivolous lawsuits), but talks about how the resolution doesn't really do what it should effectively and that repealing it would clear the way for more effective and general tort reform.

The wretched and ludicrous "Common Sense II" laws have long been a carbuncle on the legislative record of the U.N. There is no inherent 'common sense' behind legitimising vigilante actions and anarchistic behaviour, nor in demeaning the compensation claims of victims of corporate negligence, as has been pointed out by the author of the repeal. For the sake of 'common sense', I would argue that this "Common Sense II" law needs to be repealed as soon as is possible. I would, therefore, strongly support a repeal.

Thanks for the responses - In response I have added the following two lines:

ACKNOWLEDGES that unfounded lawsuits for the purpose of personal gain and/or to cause damage to the defendant violate the civil rights of the defendant, as well as damaging the reputation and implementation of a nation's legal system;

CONVINCED that the current resolution should be replaced with a resolution which covers a wider range of issues, and sets out the guidelines for dealing with them more clearly;

Is this more appropriate?

Although of course we now have separate resolutions that deal with workplace safety and at least some labelling...

The government of the St Edmundan Antarctic will probably support a repeal, because the resolution in question intrudes unnecessarily on national sovereignty, but keep similar laws of our own on the books anyway...
