2nd Draft Proposal: Repeal Resolution 6 (End Slavery)

Kiften
17-02-2006, 02:19
Category: Repeal
Resolution: #6
Proposed by: Kiften

Description: UN Resolution #6: End Slavery (Category: Human Rights; Strength: Significant) shall be struck out and rendered null and void.

Argument: This Assembly,

DENOUNCING all forms of slavery, wherever they might exist;

UNDERSTANDING that legislation to defend against the possibility of slavery must ensure that said laws prevent misinterpretation or abuse;

RECOGNISING Resolution 6, "End Slavery", as a worthy attempt to tackle this problem, but flawed and ineffective for multiple reasons, and as such hinders the ability of the UN to fully eradicate slavery and its associated abuses;

NOTING the following inconsistencies and problems inherent within Resolution 6:

1) The lack of a definition for slavery
2) The statement outlawing the selling or purchasing of people does not grant freedom to any current slaves, effectively allowing slaveowners a 'grandfather clause'
3) The right to travel freely is in direct contrast with a government's ability to imprison a suspect or criminal, to enable a quarantine for contagious diseases or devastated areas, or provide restriction for unauthorized access to any place
4) The right to bodily safety from one's employer is worded vaguely, as one's employer might require said employee to participate in a function of his job which could hold the possibility of injury
5) The right to two week's notice is incompatible with many jobs, such as military and contract work
6) The 'right to own possessions' clause in the original is poorly written, and may preclude some UN governments from complying with this section

HEREBY REPEALS resolution 6, rendering it null and void

STRONGLY URGING the introduction of a more effective replacement resolution as soon as possible.

A replacement draft is being drawn up that promises to be much more comprehensive and eliminate any possible loopholes that might exist.

(Sigh) OK, this is the last time: You repeal a law because it is bad law, not because you'd like a shot at rewriting it. These automatic replacement proposals are tiresome.

Yes, but Kiften is trying to repeal this one because it is a bad law, but then he's going to "replace" it with a better one. As the repeal text points out, #6 does have some loopholes.

I agree it's tiresome in general, but in this particular case, I think this is a bad law that needs repealing, and also that slavery is something which requires effective UN action.

And I don't really like 'Freedom from Slavery': I think 'Abolition of Slavery' would be better.

But what sort of chance do you think there'd be of getting this proposal repealed without having a replacement ready to submit immediately afterwards? Pretty well none, I would say...

St. Edmund,

I am also working on the replacement and trying to get it as airtight as possible. Your thoughts and comments on the replacement would be highly appreciated, as would any other who cares to review.

I think I have stated many valid reasons on why Resolution 6, as written, is very flawed. This is not just a repeal to repeal. This is a repeal because there are MULTIPLE problems with the original repeal, one of which is very serious. The fact that a 'grandfather' clause is allowed in the original resolution is very serious, as it only prevents the buying and selling of slaves IIRC, and not the ownership. It also doesn't even define slavery.

Please help me in enacting a law that will protect all peoples to the best of our ability, and not allow scapegoats and word laywers to bend the law in a twisted defiance of what its intended purpose is.
