Question on the death penalty.

I was just reading the Right to Refuse Extradition (http://forums.jolt.co.uk/showpost.php?p=9052878&postcount=104) resolution and something jumped out at me...

AFFIRMING ALSO that this resolution shall not affect each nation's sovereign right to allow or ban capital punishment within its own borders

Would this clause make any proposal trying to ban or enforce the death penalty in all UN nations illegal?

As I'm not an expert on reading between the lines on proposals and tend to accept them as written, it seems like it does to me. Just wondering what others think of this.

after reading the same line it looks to me that the author meant that a nation still use or choose not to use capital punishment.

its a simple statement of sovereignty as far as I can see.

it doesnt, i dont think. but if it did, it could have some serious rammifications in reguards to other resolutions, and some could even be deemed illegal by other resolutions.

Nope, it just says that resolution has no effect on that area, it doesn't actively reserve it as a right of nations to never have their capital punishment policies overridden by a different resolution so no future resolution would be contradicting it.

Key word highlighted. It places no restrictions on future Resolutions.
