RESUBMITTED: Repeal "UCPL"

RECOGNISING that copyright and patent law are fundamentally different methods of protecting intellectual property;

NOTING WITH REGRET that this resolution makes no distinction between the two;

REALISING that there are profound differences in the way nations view the value and ownership of intellectual property;

BELIEVING that copyright law and patent law are such inherently complex concepts that no single resolution can formally and effectively create a universal system of UN law in this regard;

DEEPLY CONSCIOUS that the mechanism for sharing copyright described in UCPL would be impossible;

ALARMED at the cost of constructing and maintaining over 30,000 separate chapter offices in member capitals, and further sub-agencies;

REAFFIRMING the importance of global cooperation in copyright issues;

EXPRESSING ITS HOPE that nations will continue to work together in this respect;

BELIEVING that a more effective replacement for "UCPL" can be achieved:

REPEALS "UCPL".

at the moment these are just aims and ideas but may help.

most nations have some form of copyright and patent laws. however some don't give protection to an idea. (a RL example was spain from around 1914 to the mid 30's. their copyright laws allowed people to reproduce anything that was available in spain. hence the spanish turned out milions of copies of automatic pistols and revolvers for the various european armies during the great war and beyond that time until general Franco out an end to the practice).

a resolution that states that UN nations respect and maintain existing copyright and Patent laws within and outside the boundaries of the UN would be a good starting point since it also protects and respects the nations outside the UN as well. it's also natsov friendly and confirms in writing how we would expect a government to handle this issue and how many do already.

I do appreciate not everyone wants a replacement. Those who do not want one should, I feel, still support the repeal: they are then welcome to campaign against proposed replacement (which, it should be pointed out, is still entirely hyopethetical).

97, tonight. Delegate approval still needed, so if you can approve it, or know a man/woman/elf/robot/dolphin/further hilarious alternative who can, please help the effort. I'm still willing to answer questions or concerns: to repeat one of the chief ones, although at this time I'm still considering a replacement, the repeal is by no means conditional on that. Removal and non-replacement of UCPL is in my eyes preferable to keeping it on the books.

Furthermore, might I add that I hope that a new version of the DRM act or such like, shall be proposed as part of the replacement package for the UCPL, should it be repealed.

Well...thanks. Although I must confess I missed your earlier argument against it. What was your objection? It's something I'll have to keep in mind in case we do try a replacement.

I assume Sunday/Monday. Basically, when PC's passes, then another update, then it comes to vote, I think.

just that if this is removed, inventers and such have to file patents or copyrights in practically evey nation in order to garentee that it wont be stolen and duplicated, and thus they get rightfull royalties
