Child Abuse - Death Penalty
A resolution to improve worldwide human and civil rights.

Category: Human Rights
Strength: Strong
Proposed by: Amerikaz

Description: NOTING THAT:

1. We're living in a time when children are being abused in all kinds of way, and we all CARE.
2. In many cases of child abuse all around the world there has been popular manifestations to KILL the abuser.
3. In many countries the Death Penalty has been outlawed; but we all know there still are ILLEGAL EXECUTIONS, wheather because of crimes commited or because of political differences.
4. In countries where the Death Penalty is legal, ussually it's cruel and sadistic.

This proposal goes to MAKE THE "DEATH PENALTY" LEGAL IN EVERY NATION MEMBER OF THE UN, TO BE APPLIED ON CHILD ABUSE.

The law "Child Abuse & Death Penalty" goes:

1. Every UN nation MUST apply the death penalty to whoever raped, tortured, killed or abused of a child (the term "child" and its age limits applies to national laws).
2. The trials for this effect must be fair and, if needed, a UN observer can be part of it to ensure justice is done.
3. The death penalty must be applied ONLY thru LETHAL INJECTION, which ensure the less-cruel of today's known death-penalty methods.
4a. The victimizer CANNOT, and WILL NOT be tortured in any way. He will receive human and humanitarian treatment.
4b. The victimizer WILL NOT receive ANY benefit. He will be isolated, and WILL NOT have a "final wish" of any kind.
4c. The victimizer can choose 1 (one), AND ONLY ONE PERSON to visit him, and ONLY during the first day of isolation.
5. Once the trial is over, the death penalty must be applied in a period NOT LONGER THAN 5 DAYS, AND NOT SHORTER THAN 2 DAYS.
6. After the victimizer's death, the corpse should be buried without any ceremony.

We expect this proposal to take effect, and we will see the results of a strong but not cruel law applied to make this world safer to us and to our children.

There's no chance of this passing. Many nations in the UN, including my own, have outlawed the death penalty in their countries and want it kept that way.

No, I'm sorry, but while I like the proposal, I cannot support anything that forces a nation to use the death penalty. If you could word it as the "highest punishment available in that country" I would support it, but many (and very possibly most) countries consider the death penalty cruel and unusual punishment.
Secondly, this shouldn't be strong. Significant would be push it. It doesn't effect everyone, just a select few perverts and unfortunate victims.
Thirdly, what if a country declares the legal age of consent to be 3 years old?

Exactly. If you remove the parts about the death penalty, parts 4b and 4c, and the "burial without ceremony" part, and change the part about age of consent, I'd support it. You can't set an age limit (like 18, for example), however, because in NationStates there could quite possibly a nation of bunny people whose lifespan is only 12 years. Perhaps "below the age limit which marks one as an adult in his/her respective population, culture, or species."

Also, there is no definition of abuse, so abuse could well be defined as "Giving a spanking" or "denial of ice cream."

:D Hadn't even notice that one.

Nargopia will never support a resolution mandating the use of the death penalty. Hell, we'd be hard pressed to support one abolishing the death penalty. Chalk it up to good ol' national sovereignty, I guess.

Thank you all very much for your feedback.

I'm gonna work on a new proposal.

This one was meant to give a severe punishment to child abusers, stating that there'll be NO TOLERANCE to this behaviour.

If this one doesn't pass, We'll work on a new one.

Thanks

Don't bother I've tried passing death penalty proposals three times now but the UN is full of nations who believe that Murderes, psychos and rapists should be treated like human beings.

Not true, I stand as a nation who has outlawed the State sanctioned Killing of Our nastiest element but not because we recognise the rights of these Horrific monsters. It is a safeguard against an Innocent being killed after being found Guilty of a most haenous crime. You can free and compensate a wrongly accused Perp who is serving a life scentence ( life = Life, Untill the Perp dies in incarceration). How can this justice be given to one whom has had their life taken?

The other problem with your proposal, if i am reading it right, is the time period in which the punishment is to be enforced. While we all wish they were, the judiciary is not infallible and mistakes are made. By imposing the mandated sentence (which i also have a problem with on several levels - national sovereignty being the most important) there will be no time for an appeal.

I'm sorry, but my nation could never accept this policy. As many have stated before, too harsh, and things which are not abuse can be counted as abuse.

Also, many of the people doing the abusing have been abused as children, they are imitating. Not that this in any way condones the abusive action. Still, why not try to help them change instead of killing them off and never giving them the chance. Our nation, like many of yours hates child abuse, abuse of any kind for that matter. But killing off people will not solve the problem.

Mandatory death penalty? That's a national sovereignty violation. Five yard penalty. ;)

Even though in my nation Death penalty is applied liberaly for most infractions, I will not support this proposal due to the fact it infringes on other nations' right to punish criminals how they see fit. Many nations have abolished the Death penalty and this would cause a serious social issue for these nations.

Suggestions for the proposal:

Make sure you clearly define what constitutes as Child Abuse.

Don't mandate the death penalty. Leave it open so that some nations may use it, but you'll get more support if you leave an option for those of us who have made the death penalty illegal.
