UNITED NATIONS RESOLUTION #91

The Sex Industry Worker Act
A resolution to reduce barriers to free trade and commerce.

Description: The NationStates UN,

RECALLING resolution #46 "Legalize Prostitution" and the repeal of that resolution,

ALSO RECALLING Resolution #7 (Sexual Freedom), and Resolution #53 (Universal Freedom of Choice), which make sex a private issue, instead of a government issue, and stating "a populace granted the freedom to make choices in life is a happier, more content and more productive society"

AFFIRMING in accordance with the above mentioned resolution that each person has the right to decide over their own body, and has the right to sell ther body if they decide to, without government interference,

ASSUMING an increase in Sexually Transmitted Diseases, as well as an increase in crime, and higher pressure on police, in a situation where prostitution is illegal,

ACKNOWLEDGING that health risks exist, even with legal prostitution,

1. DECLARES prostitution legal throughout the UN: any person who is mature ,and capable of making their own decisions may become a prosititute,

2. EMPHASIZES that legalizing prostitution must coincide with regulation from the government, such as health and safety and other employment legislation, just like any other profession,

3. RECOMMENDS nations that want to limit prostitution to tackle the issue by its roots and create education and social programs that will give more choice to people who might want to become a prostitute,

4. REQUESTS all nations to stimulate a clean and attractive working environment for prostitutes, and advises cooperation with the sex industry to renovate old "illegal" prostitution areas in towns and cities,

5. CONDEMNS child abuse and slavery in accordance with earlier UN resolutions (End slavery, Child Labor, Outlaw Pedophilia, The Child Protection Act, Ban Trafficking in Persons, etc) and advises strong punishments against people involved with these despicable crimes that explicitly are not covered by legal prostitution.

If you can post a reasonable repeal draft, without the use of smilies and without insulting about 5,000 people, I may consider helping you draft it. But don't count on it.

The danger to public health is if you can't be bothered to have a health program worthy of even calling you a UN member. The morality issue is subjective and, frankly, invalid. Provide an arguement that hasn't been done to death and shot down every time and maybe you'll have a repeal worthy of looking at.

Good Gods. Even the poll question is a misrepresentation. The first post is not only a direct attack against people who had a reasonable debate (well, a debate, anyway) on this very issue not so long ago, but filled with inaccuracies as well. Heck, Krioval has a festival in which wanton orgies are a major part, and yet overall transmission of STDs is lower in Krioval than many other places since routine testing is strongly encouraged to the point of intrusiveness. For example, if someone wants to participate in that festival, or become a government-regulated prostitute, that person must demonstrate that they are healthy, and even then, various methods of protection are employed. Couple that with very restrictive laws on spreading STDs through government-regulated prostitution or falsifying health data, the problem practically disappears.

As for the "immorality", that argument flies here as well as a rock. In other words, it makes a brief splash and then sinks into the abyss.

isn't that an issue for the individual nations to decide upon? or do those issues only go to nations outside the UN?

Yes there is, and that is having illegalised prostitution.
we are in agreeance with fass. at least with it being legal, you can put standards in place to reduce the occourance of STD transmission. as for morality, that i believe is up to each individual nation to choose, not have forced upon them

Seriously. Don't make accusations without first doing a bit of simple homework.

Second, I'll re-explain my government's support for this resolution. My nation is a capitalist society. This resolution calls for increased deregulation of prostitution. Namely, a law that completely bans prostitution is the most extreme form of ban (restriction of commerce) that can exist.

My government can understand a nation that has a completely controlled economy wanting to control the sex industry, but the research in many of our nations has shown that by allowing the sex industry (but regulating it to a lesser degree than an outright ban), means that the government can tax the industry and also uses those taxes to provide health and safety benefits.

It is very illogical to say, "Automobiles are dangerous, therefore we shall make them illegal."

They are dangerous. That is a fact, that is supported by any number of death statistics.

However, the proper capitalistic response is not to simply ban automobiles, but rather to make a "cost" for using them that encourages safer use.

In the case of prostitution, this resolution actually built in several costs (via health care clauses) that would add that level of accountability. Frankly, my government has found that many of the "Free Trade" resolutions were not really attempts to deregulate particular industries, but this resolution was and my government can attest to the success of this resolution.

Those of us who believe that no state can lay claim to ownership of the body of a sapient being, and so the true wrong is for the state to dictate to the individual what s/he can and can't do to his/her own body; and those of us who recognise that modern medical technology, used properly, offers ways to make sex, even promiscuity, relatively safe.

I think it is immoraly wrong, sends bad messages to the society (especially the children) and doesn't prevent the spread of stds.

But on the other side of the argument ya it is more safe and it might not be so wide spread because of the fact of something being legal takes away the thrill of breaking the law.

In the UMCD we educate the population about the facts of prostitution and have strict guide lines (like no where near schools and as many medical screenings for stds are possible) of prostitution work.

They are dangerous.

I don't believe that's true. Automobiles, alone, are not dangerous. Automobiles are not dangerous. People making poor decisions while operating one are dangerous, and can turn an automobile into a makeshift weapon, but the automobile is no more or less dangerous than before.

But you are focusing on the wrong part of the analogy ...

What is the solution to encouraging responsibility with respect to automobile ownership and operation?

Since you are agreeing that people are capable of making lethal decisions with automobiles should not the government ban them?

To me, this sounds like a crazy man's idea ... and yet if you look around, people will say this with respect to other things.
