Sorry for the title, Before you all go after my livelyhood should be a seperate sentence from Repeal "END BARBARIC PUNISHMENTS" But now it is impossible to change it.
It seems after a monumental failure of my last proposal, that I have done something else that will most likely cause me bodily harm from other Nations and/or Mods, but this is not the case. I have learned from the errors of my last proposal and have given what I believe to be suffient example on why this should be repealed and something else replacing it. If you do not feel that the example is good enough to justify repealing it, you don't have to vote for it, But since it is imposible to amend a Resolution and trying to propose something that conflicts does not work to well, the only real reason why I brought up this issue is because there are special circomstances in which physical force may need to be used to save the lives of others. If this should become a resolution, I personally, along with i'm sure a few dozen angry nations, will draft up a new proposal that outlaws torture except in special cases in which the information gathered will be used to save lives. If this angers any one, please go ahead and express your feelings, but let it be known that the only reason why I am trying to repeal this Resolution is because I feel that it can be made better.

Description: UN Resolution #41: END BARBARIC PUNISHMENTS (Category: Human Rights; Strength: Significant) shall be struck out and rendered null and void.

Argument: While this Resolution should hold true in almost all cases, there are a few very special exceptions in which this would endanger the lives of others. An example is that in an obduction case, where previous victims were murdered, and a suspect is being aprehended who is believed to have information about the case. What if the cop used physical force to get information from the suspect, which eventually led to the saving of the victim? Is the cop to blame for roughing the suspect to save an innocent persons life? Should the information obtained be thrown out, allowing these people to possibly harm other innocents?

While I do believe that laws are required that make torture illegal, it should have some exceptions. If it should come that this Resolution is repealed, a propal should be made that outlaws torture, except when the information extracted through torture is used to save a life or lives.

ummmm, i say not. in the time it would take to write a proposal, submit it, have it approved, then voted on, many nations that take a disliking to this resolution for more extreme reasons could effectivly torture their entire population. once you start saying "there should be an exception for this" and "there should be an exception for that", nations will start abusing the loopholes and make up some story supporting their actions. knowing the proposal system and what it entails, i say a whole-heartedly NO to this repeal

Special circumstances always allow for special actions.
The lawbreakers can always be pardoned after the fact.

OOC: While it made a great plot device in "Guarding Tess", I remain unconvinced that torture ever produces actionable intelligence.

OOC: i agree there. people will say anything to make it stop, so how can you garentee that it is the truth, and not just a ploy to make the torture stop?

Vastiva does not believe in torture - it is fundamentally useless.

Besides which, our methods of extraction are far better, far more accurate, and do not abridge torture.
