DRAFT: Repeal #7 Sexual Freedom

Description: UN Resolution #7: Sexual Freedom (http://www.nationstates.net/cgi-bin/index.cgi/page=UN_past_resolutions/start=5) (Category: Human Rights; Strength: Strong) shall be struck out and rendered null and void.

Argument:

Observing that Resolution #7: Sexual Freedom bars state concern with activities between two or more consenting adults in the privacy of their homes without specifying sexual activity, therefore protecting a large number of activities that may be necessary for a state to interfere with, such as counterfeiting, selling nuclear secrets, violating gag orders or distributing child pornography;

And Recognizing that sexual freedom and privacy is already protected by numerous UN resolutions, including #10: Stop privacy intrusion (http://www.nationstates.net/cgi-bin/index.cgi/page=UN_past_resolutions/start=5), #12: Gay Rights (http://www.nationstates.net/cgi-bin/index.cgi/page=UN_past_resolutions/start=10), #46: Legalize prostitution (http://www.nationstates.net/cgi-bin/index.cgi/page=UN_past_resolutions/start=45), #53: Universal Freedom of Choice (http://www.nationstates.net/cgi-bin/index.cgi/page=UN_past_resolutions/start=50) and #61: Abortion Rights (http://www.nationstates.net/cgi-bin/index.cgi/page=UN_past_resolutions/start=60)

We recommend the immediate repeal of Resolution #7: Sexual Freedom.

In The Republic of Adam Island we are undergoing an interesting domestic crisis. Police have arrested two persons suspected of selling military secrets to a foreign spy, from a nation that shall remain nameless due to international tension. There is little doubt they are guilty of the crime, but they have invoked Resolution #7: Sexual Freedom to contend that because their selling of the documents only directly involved consenting adults in the privacy of their home, we are forbidden from trying them on this charge due to our membership in the United Nations.

Our government supports the sexual freedom of all persons, and so before writing this proposal, we conducted a research study to ensure that even if Resolution #7: Sexual Freedom was repealed; citizens would still be guaranteed basic sexual freedoms from other UN resolutions. We have found that this resolution is unnecessary at best and a threat to global security at worst.

The resolution is written vaguely and does not limit protected activities to the sexual realm. Perhaps after the repeal another resolution with that change can be passed.

Description: What goes on between two (or more) consenting adults in the privacy of their homes should not be the concern of the state unless it is neccesary to enquire about the afore mentioned activities for medical reasons (e.g. if the individuals wish to give blood etc.).

I have to disagree. I find it unbelievable that someone would use the cover of sexual freedom to break the law and expect not to be prosecuted. While the text of the resolution does not specificy that what the people are doing has to be sexual in nature, I believe it is stated in the name of the resolution, and as such the freedom to do what you wish in the privacy of your own home only extends to that which relates to sexual activities.

While I can not deny that pillow talk can be used to obtain secrets and so on, I am more than willing to put up with that to stop the interference of the government on various sexual acts that might be considered "wrong" by the local government.

And while some might say this is a matter of national sovereignty - that if I want to let my people do whatever they may wish in the comfort of their homes, I would disagree. Because sometimes they visit with relatives in other nations, and this proposal protects them there as well as here (assuming it is UN nation).

Even if this resolution was repealed, I believe that resolution #10 would prevent governments from spying on their people without a court order. And if they can get the court order under #10, then can it not be argued they can intrude on the resolution at hand (#7) because they believe what is going on is not related to sexual activity, but to something else?

My main point is this - this resolution protects the right of people to tie each other up and to dress up as bishops before having sex. Which is fair enough, as what consenting adults do to gain pleasure is a matter for themselves, not their government (unless it concerns children, or pain that borders on assult/batterty etc). However I do not believe it protects the right of criminals to hide behind sexual activity as an excuse to evade prosecution. And I have never seen it as such. (If someone wants to tell me I am in violation of the resolution by the way I have been interpretting it, feel free)

Whilst I agree with Adam Island that the resolution in question is fairly vague, I don't believe that other existing NSUN legislation directly and specifically protects all consensual adult sexual activity. I'm not sure that UN legislation could be used against national laws outlawing specific sex acts (unless, ironically, they involve a prostitute).

Read the name of the resolution. It is clear that it refers to acts of a sexual nature, which makes a repeal unnecessary.

Amerikong is proud to support the repeal of the sexual freedom resolution. The third act of the new Amerikong parliment forbade sexual relations involving more than one person as a corner stone of Amerikong social policy. Given that our populaton has more than doubled in the last week it is apparrent that dissidents still continue to flaunt this law. The Amerikong Homeland Security Service has confirmed that foreign influences and a over abundant wine harvest are to blame.

The third act of the new Amerikong parliment forbade sexual relations involving more than one person as a corner stone of Amerikong social policy.

That act is invalid. UN resolutions take precedence and that act is invalidated by several of them.
