Suggestion: International Law of Secession

On behalf of the Confederacy of Bennavannin, I, Alasdair mac an t-Saoir, suggest the following proposal to the United Nations. Lacking endorsements, our tiny republic is unable to make official proposals, but we would like to impress upon the rest of the world the urgency of adopting an international law on secession.

Recognizing that the act of secession often incurs great violence when suppressed by central governments, and that a peaceful, democratic resolution of secessionist conflicts would be far superior to resolution by brute force, Bennavannin suggests that the United Nations require all nation-states under its jurisdiction to recognize a new country formed through secession whenever a majority of voters in the territory forming the new country have approved secession in a free and fair referendum. By recognizing new states created through democratic procedures, we can put a stop to the dozens of violent secessionist conflicts raging around the world at this very moment.

If the world body deems that this particular approach to secession is inappropriate, then some other international standard regulating secession must be adopted. It is the only alternative to chaos. Thank you.

Withdrawing territory from the sovereignty of an existing state and placing it under the sovereignty of a new state.

As Bennavannin considers rejoining the UN, its delegate, Alasdair mac an t-Saoir, has returned to the floor of the UN as an observer to gauge the support for introducing this proposal for a vote. Should no country introduce the proposal, it is likely that Bennavanninic public opinion will continue to pressure the government to remain independent of the United Nations.
