The International Extradition Act

The NationStates United Nations,

Observing that criminals are not always restricted by borders, and may use this fact to flee prosecution;

Considering the jurisdiction of the harmed nation;

Understanding that certain crimes are more severe than others;

Noting the rights granted to all people;

1. Requires all nations to extradite those suspected of significant criminal acts to the nation in which the criminal act took place.

2. Also requires that a nation which is prosecuting a citizen who has been extradited must allow legal counsel from the citizen's home nation to represent their interests without risk or threat to themselves and that legal counsel familiar with the prosecuting nation's laws and customs be appointed without cost to inform the other counsel of legal options.

3. Requires that all nations, upon determining that the extradited citizen is not guilty of the accused crime, allow for free passage to the citizen's home nation.

OOC: This is my first draft of my first proposal so be nice ;) Some of the language seems a bit wordy to me.

The sentiment is good, however many nations will be loathe to extradite criminals to natioans with very poor human rights records. For example, would you send a petty thief back to a country were he was guaranteed to have his hands chopped off after a sham court?
If you can couple it with some reference to humane treatment of prisoner then it would be good.

I've made the appropriate change and submitted it as a proposal. Now all I need is the support of the UN Delegates.

We concur with the delegate from Kelssek. This is a promising first draft but careful consideration of the different rights granted by nations to their citizens must be made.

Section 1 was modified to read:
1. Requires all nations to extradite those suspected of significant criminal acts to the nation in which the criminal act took place unless there is credible reason to believe the citizen will not be treated humanely.
