Fair Trial Issue

The United Nations is a broad organization specializing in specific international case issues. An issue dealing with the domestic nature of a particular independant nation is inherently a matter to be dealt with by the authorities of that particular nation. This is the core value of National Sovereignty, which is also a key value of democracy.

To pass this proposal would be to infringe on a nations particular sovereignty rights. Remember, the U.N. deals with international issues primarily, not with invading the privacy of nations.

Also, line item specific issues: this proposal has no exceptions to be made for political prisoners as product of a war, or non-citizen combatants. It is common custom to bring enemies against a nation who do not fit as POW status under the rules of war into trial within a military, or in some cases civilian, tribunal in the nation that was attacked. In some situations this proposal would require that these enemy combatants (EC's) be tried in the specific regions in which they executed their attack, which could be in the middle of a jungle for all we know. This primarily stems out of the lack of a definition to differentiate from a citizen and an EC, and furthermore it does not designate what non-citizens will be entitled to if any difference (as there must be a difference).


It is imperative that this proposal be negated for the essential core values of Democracy in an international state.
