War Crime proposal

Too often leaders of nations commit war crimes. Killing POWs, soldiers who wish to surrender, civilians are just some of the crimes. These people should be brought to justice. I wish to know your imput in what should be included in a proposal to the UN on war crimes.

Define ‘war’. Define ‘war crime’

Would the punishment fall on the solider or the person who ordered the attack? We think the latter would be better.

The person who ordered the attack would be tried the same. But the common soldier who carried out the ordered knows that what he is doing is wrong. The Nuremburg Trials set down that the "I was just following orders" excues was not going to work. The private should know when ordered to gun down the POWs is against human nature he should refuse though it may cost him his life.

if you can't do the time...don't do the crime !

Is killing in a war murder or just defense?
If your the one declaring the war (and no one else suspects).........

Punishment should fit the crime...give 'em to the survivers to deal with!

The Geneva Conventions regarding the laws of warfare are sufficient. We do not need more war crimes legislation, we just need to better enforce the laws on hand, but care must be taken not to apply them to situations in which they should not be applied (as the excessively zealous proponents of an ICJ have attempted in the past).

In addition, many nations reserve the right to ignore aspects of the Conventions. This has a built-in deterrent, because other national leaders would presumably be encouraged to withdraw their support, to let trade slack off, and so on - things more harmful than arresting a leader or two.
