Cessation Of Work Stoppages
A resolution to improve worldwide human and civil rights.

Category: Human Rights Strength: Significant Proposed by: DragonWolve
Description: Proposal #1 - Regarding Work Stoppages -

This proposal is intended to address the current pressing issues of work stoppages being inflicted upon countries all across the world. Work stoppages by union members affect many differest aspects of the lives of our countries, including but not limited to: decrease of wages earned by hard working citizens; shortages of foodstuffs, materials and items necessary for day to day living; disruption of trade between countries, thereby affecting millions of people; and the economy of all countries involved. This proposal shall attempt to curtail the necessity for such work stoppages, and keep all aspects of the country(ies) involved.
This shall be achieved by implementing the following order:

1. During the existance of this agreement, there shall be no strikes, picketing, work stoppages or disruptive activity by the union or any employee.

2. The union shall not sanction or abet or condone a work stoppage, strike or disruptive activity in the country.

3. Any and all unresolvable issues between the Government, an Employer or any affected persons shall be brought to a 13 member panel of unbiased arbitrators. Arbitrators cannot be related to, married to or work for the corporation which will be involved in the arbitration. The arbitrators sole purpose is to assist in finding a fair and equitable solution to the issues brought before it by the employees or governing body. This governing body includes but is not limited to Employers, Governments or Trade Officials. During the time of arbitration, there will be no work stoppages or slowdowns, and any malicious activity perptrated by any member of the union or the company involved will be prosecuted and the guilty party will be sentenced to no less than 3 months of incarceration, and will not be paid any lost wages. Anyone found guilty of attempting to or carrying out any form of bribery shall be sentenced to a mandatory 6 month prison term and will be required to make restitution of 10 times the bribe amount payable to the workers choice of charities.

The goal of this proposition is to create fair working environments to our workers, maintain integrity within businesses and keep the flow of trade at an optimum level.

Ehh....no.

An individual is free to choose for himself whether or not to work. He is also free to conspire with others to choose not to work on a large scale.

Then an employer should not be bound by any contract or understanding to continue to provide employment to individuals who so conspire.

Contracts give rights with equal obligations to all parties. Violate the contract, lose the right incur the obligation or remedy the situation as provided.

This proposal avoids whimsical stoppages and likewise protects the rights of labor through binding arbitration.

Think it throught. The contract concept is correct.

Well...not sure what you mean.

Should he be bound by law to keep striking workers in his employ? Of course not. Just like anyone else, he is free to associate with whom he chooses and base that decision on whatever he wishes. However, if there exists an actual contract between employer and employee stating that if the employee strikes he will be retained, than everything else being equal he is obligated to abide by that contract.
