I have two questions to ask:

1. Once someone creates a nation on nationstates, and then wanted to use the name of that nation (and perhaps its backstory), can they do that, or is that a copyright issue?

2. With complete consent of all parties involved, can a roleplay be used as a basis for a real-life novel (after massive amounts of editing of course)?

Mods aren't RL lawyers, but chances are that the content you created isn't going to include much mention of NationStates or Jennifer Government. If it does, you can take that up with your own (and if need be, Max's) lawyers before you publish.
