Your Nation's Justice System

If I had my way
04-04-2006, 23:07
Our Justice system is modelled on Lord Thomas's controversial "Felony Sentencing Act 1977". Under this scheme most "pre-meditated" felonies such as burglary, street robbery and store robberies carry a minimum prison sentence of 20 years.

This sentencing law usually even applies on the first offence. However, since there must be evidence beyond reasonable doubt, the sentencing law is sometimes only applied after the second offence or if the person offends while on probation.

Many liberals complain that our justice system has no emphasis on rehabilitation, and some judges complain that the law does not allow for any discretion. However as a result we have a very low crime rate (1,023 per 100,000), but a very high incarceration rate (528 per 100,000).

Jury members must take a course and pass a test before they can apply for jury service and high court judges are voted in by selection committees, who's members hold public elections every four years. Local communities then elect local magistrates in public ballots that are held every four years.

There is no right to bail in our nation, and so people are often remanded in jail for up to a year while awaiting trial. This can then lead to compensation appeals if the defendant is not found guilty, which creates plenty of employment for lawyers. For this reason, local magistrates often request to police departments that they do not charge people who can afford lawyers or who may make an appeal if the court system messes up.

Tell me a bit about the criminal justice system in your nation.

What is your nation's crime rate and what is your nation's incarceration rate?
Ariddia

The Ariddian justice system focuses on rehabilitation and community service sentences. As a result, crime is virtually non-existent. A detailed description of the judiciary system can be found here (http://ns.goobergunch.net/wiki/index.php/Ariddian_government_and_judiciary#The_Judiciary).

Note that special provisions apply for Indigenous Ariddians:

While Wymgani citizens attend the same courts as Sele'eosh (non-Indigenous) citizens, any Wymgani defendant or plaintiff may require that a recognised expert on Wymgani customs and culture be present in court, if two or more judges or one or both factual assessors are non-Wymgani, to inform the judges of any specific and relevant issues pertaining to Wymgani. The choice of the expert is subject to the approval of the defendant, the plaintiff and the judges, while the Wymgani person requiring his or her presence may decide whether or not to allow a non-Indigenous expert.

Any court may, in addition, decide to refer a Wymgani defendant to judgement by his or her local community, in accordance with traditional Indigenous law, if the plaintiff does not object.

There is also a Wehela Aui u Sheho (Indigenous Land Court), presided over exclusively by Wymgani, and which is tasked with reviewing Wymgani land claims. This Court does very little today, as most land claims have long since been settled.

Kanami
05-04-2006, 01:36
Upon Aresst, you have the right to remain silent, and to have an attorney. An attorney will be porvided to you, if you can not afford one.

Bail is set to flight-risk. However, bail has to be paid in full. You can't prove your house is worth 5,000 Kanamians, and bail this person out. (This applies to felonies only)

A jury must decide if the person is guilty or not, but a judge may overul the ruling with a reasonable appeal. These can only be brought up if EVIDENCE shows, or new evidence surfaces, that this case must be re-examined.

The Brand new Evidence will be filed to the Justice Department, the Defense Attorney, and Prosocution. And if need be Investigation Organizations such as the FBI, Homeland Security, etc.

there is almost no crime because of pervasive military force. when there is the guy is thrown to jail, without proof or anything. then the government does trial and chooses the number of year of prison sentence, torture, or death sentence.
(what else do you expect from dictatorship?)

Zukaria is brutal when it comes to crime, because of this, there is hardly any, and there was hardly any before. The people love their country and the Emperor, so crime is pretty low.

Robbery/theft-
First offense: you get your stolen goods taken and a year in prison.
Second offense: Hand chopped off.
Third Offense: Ten years in prison.
Fourth Offense: Death

Assault-
First offense: chained up and beaten.
Second offense: Twenty years prison.
Third Offense: Death

Murder-
Death

Its basically the "Eye for an eye" system.
Gwazzaria

Gwazzaria functions on the 'innocent until proven guilty' principle, and adheres to it quite strongly (which is why they make sure to prove without leaving room for doubt certain people are guilty). Judges are appointed by the governmental administration, and juries chosen by 'undisclosed means'. Everyone has the right to an available attorney of their choice, all of whom work for free and are paid by the government.

Judges may overrule a jury's decision with permission from the Minister of Justice. Punishments are generally impermanent (fines, etc.). Execution can only be issued by the Duke, and is generally reserved for mass murderers, serial rapists, et cetera.

Pythogria uses fair trials most of the time (at least where there's doubt.) When the perpetrator is confirmed, however, police can give him a sentence immediately. (This doesn't happen much.) Offenders are usually thrown in prison, but murder, rape, andother offenses can net death penalties. They are given via firing squad.

Life In Prison

You are innocent until proven guilty.

You are provided a lawyer if you can't afford one.

A jury of 16 randomly selected individuals, of which there are 6 of each gender decides your fate.

A judge has the power to overthrow a jury's decision with permission from the King or President first.

Crime of any kind is practically unknown. (Would you commit a crime under those punishments?...) our prisons are only at 17% capacity.

I will post minor crimes and their punishments later.
San Haven
05-04-2006, 07:37
San Haven uses a good Justice System. Upon Police catching a Perpetrator, they have laws to keep them at the nearest Police Station for up to 72 Hours. During this time, the are tried for their crimes & evidence but be obtained. If found Guilty they are severly fined or Sent to Jail. If not, there free to go. The Police use Database througout the nation. It shows details of all people, whether the have/have not commiteed crimes etc. Crime is quite low these days.

Unlike others, San Haven does not have the Death-Penalty on the beliefs of no matter what you did, your life should not be taken! Life-Term Sentances are rarely give out, however over 78% of Criminals are serving sentances between 5-18 Years.

Mine is somewhere between San Haven's & The Australians systems. No Death Penalty. I agree with San Haven. We encourage those under the age of 17 to do community service rather than serving short-term sentances (3 Months - 5 Years) for the wrong doings.

Instead of havng all crimes with their own penalty, crimes are organized into a ten level system. Level 1 crimes are the most minor, and they are only punished with a small fine (like around 100 swillas). Level 10 crimes are the highest, and only include crimes such as murder. They are punished by 30 years imprisonment, which is the longest time someone may be imprisoned in the democratic capitalist empire. The death penalty is not used.
Romanar
05-04-2006, 17:14
Romanar has an "innocent until proven guilty" system. It has the Death Penalty, but it's only used in the worst murder/rape cases.

There are frequent allegations of police brutality, but none of them have even gone to trial. A couple almost did, but since they led a dangerous lifestyle anyway, they got their heads bashed in. And, no, it wasn't by the police.

OOC: The above is an official statement from the Police Commisioner of Romanar's largest city.
Minikuku
05-04-2006, 19:05
The justice system of Minikuku goes from fines for littering and speeding to life in prison. Each defendant is required to represent themself in court, with an officer presenting evidence for prosecution. Lawyers are non-existant.

We do not have the death penalty; however, we have found that prisoners do not last long in our prisons and are working to fix this flaw.

Szanth
05-04-2006, 19:33
We have no crime in Szanth. =)

However, on the off-chance something happens, there's usually a plateau system type of thing to where anything below seriously wounding or killing someone is treated with psychiatric help and spends weekends with their victims while being monitored so that they can understand what they did and how it affected people and why it's bad - if the victim was killed, we measure on a scale of honor, whether or not the kill was honorable. If the man was killed in a fair fight, the killer will serve a year's sentence in a prison, being treated mentally so that those the victim left behind will be able to understand exactly why the person was killed and who it was that did it (whether it was a matter of personal pride or an argument or just a challenge or what). If the person killed him in a dishonorable way, the man is forced to commit seppuku.

If it was worse than seriously wounding or killing (i.e. torture, mass dishonorable murder, etc) then the person will be tortured and forced to commit seppuku.

But yeah. We have no crime in Szanth. =)
