Most serious crimes in your nation, and sentences.

Which crimes does your nation view as most serious, and what penalty do offenders face?

Genocide / crimes against humanity: 25y jail (24y minimum to be served), followed by 20y police surveillance and emigration ban

Premeditated murder: 25y jail (15y minimum to be served), followed by 8y police surveillance

"Spur of the moment" murder: 22y jail (8y minimum to be served)

Rape / child molestation: 20y jail (8y minimum to be served), followed by 8y police surveillance

Animal murder / meat-eating: 16y jail (4y minimum to be served)

All prison sentences come with extensive counselling, psychiatric help, and rehabilitation programs.

For less serious crimes, a short term of community service is the usual penalty. Fines are rarely issued, as they are viewed as a relic of a less just, capitalist society. Bail is non-existent (for the same reason), but prisoners awaiting trial may be released into family (or other) custody free of charge, except those having committed one of the most grievious crimes stated above.

Well, just after Danneland added a death penalty to drunk driving. 50 000 persons were executed. After that, we rarely see anyone driving drunk.
About 1-2/ every other week.

agreeably death penalties are useful so long as the people in charge of sentancing and execution don't get carried away. It certainly stops crime as not many people would agreeably want to die. But governments tend to enjoy it too much and sentance the innocent

Murder, be it single, premeditated, mass, or serial, is nominally the most serious crime, but it is rarely investigated in the poorer districts. In the richer ones, enough money is usually on hand for the murderer to pay off the judge and local authorities and escape with only a 'get out of town' warning. When a successful prosecution occurs - usually in the case of a poorer citizen murdering a richer one - the sentence is most always death, usually by hanging.

Piracy is often a more serious crime than murder for the simple fact that it is tried by a naval tribunal rather than the civilian courts. Convicted pirates are always hanged; their leaders' bodies are usually suspended by the waterfront for a few months. Various military crimes, most of which end with a 'guilty' verdict, such as desertion, cowardice, and the like, are punishable by firing squad.

Genocide/Crimes against humanity-Death by Vaporisation. you are placed in a blast-proof room and shot at full power by a turbolaser (The kind we use on starships.) Death is instant.

Drink Driving: Death By vaporisation. We cannot tolerate people in their anti-grav cars falling out of the sky on alchahol.

Murder: Death. If proven insane, life in prison.

ANY other crime: Life in prison.

As a result of this, crime is now all but unknown within The Imperial Navy.

Our Master, the Ultimately Just and Compassionate one, provides guidance and providence for all his loyal subjects. The only crime is the rejection of his generousity, which rejection is a sign of the inhumanity and irredeemable mentality of the culprits.

In this harsh world, rejecting the only true guardian and protector of life is unthinkable, and the self imposed consequences are inevitable.

In our blessed state, all sins are considered crime. Punishments go from simple enforced praying, jail, torture, exile and execution, and of course, Damntation in hell to the sinners.

While there have been calls recently for adoption of the "Greenlandic Model" of criminal justice policy (i.e. community-based counselling and rehabilitation services in lieu of jail time across the board), Enodia's justice system is yet to adopt such a radical change.

The most serious crimes are Premeditated Murder (Vorhergedachtesmord - lit. "The murder which was thought of earlier") and Treason, both of which are punishable by life sentences. In extreme cases, such as serial killings, the Chief Justice of Enodia may recommend the criminal be listed as "Nie Heraus zu Kommen" (Never to be Released) by the Attorney-General. Such recommendations are made via an Act of Parliament and are usually agreed to by both sides of politics as a matter of course.
Of late, statute law has been toughened up as regards sexual assault - particularly of minors. While there are no mandatory sentences for either crime, recent sentences have tended towards life sentences, particularly where minors are involved. It should be noted that "life" here does not mean "the term of one's natural life", but rather that parole can be applied for following 30 years of detention.
Conservatives have publicly claimed that they would re-work the Penal Code to allow "Life sentences for anyone committing the same crime serially", however these claims have been laughed off by all mainstream political groupings.

Nouvellian law provides for a very strict, hardline criminal policy. We believe that having this policy will teach criminal offenders a lesson. Too often criminals spend most of their life shuffling in and out of jail, and we don't want that. Sentences are very heavy--very serious offenses can get the death penalty--and we do not believe in rehabiltation. Call us totalitarian, call us inhumane, but we actually have a very low crime rate.

Draqueen has yet to adopt any withstanding positions to changing its law enforcement policy or the permanent manners in how it decides to treat certain crimes. However, seeing as the nation is new and has yet to host many undeviating forms of anything yet, crimes are taken in a serious method and each criminal is given time to prepare a statement and to portray himself or herself in front of *Lord Lykouleon. Smaller crimes such as disturbance of peace, misuse of special abilities, and various other small disruptances. Larger crimes of murder-- accidental, impulsive, or intended-- are treated much more carefully. While Draqueen's death penalty is in place, it is used more-so as a last resort, and by allowing audiences with the *Dragon Lord, those innocent have yet to be knowingly punished.

(OOC: *Mineko Ohkami's "Dragon Knights" manga; I felt like trying to simulate it and I really couldn't picture anyone else ruling, and figured I'd give the benevolent ruling thing a try. So, if it's sounds nonsensical and ridiculous, that would be why. )

Personally, I think that child molestation/rape should be higher on the list than "spur of the moment murderers"- those kind of sexual offenders deserve more than between eight and twenty or so years.
When or if the issue concerning child molesters/rapists comes to me, I'll probably choose to either give them life in prison, the death penalty, or just castration. (I'm leaning more towards the death penalty, though).

many punishments to crimes involve public spankings

crimes which result in short jail sentences are theft, trespassing on government property, being poor, assualt which results in only minor wounding, driving without a license and many more

if a crime is serious enough the perpetrator may be killed in many ways
most of my personel tell me that its impossible to kill the same person in more than one way but im going to prove them wrong one day

The most serious crime in Waughslind society is rape. The punishment is quite painful. The rapist is strapped to a tree, their genitals coated in honey, and a trail of honey is dripped down their leg and across a fire ant's nest. The rapist is then left for three days. This almost guarantees that they will never use their... equipment again.

Our criminal justice system is based on the accused ability to pay for their crime. By pay I of course mean in purely financial terms. Some but not all of these are set out below:

1 mont = approx $1.7

1st degree murder – 5 million Monts. Else life without parole.
2nd degree murder – 3 million Monts. Else life without parole.

Manslaughter – 1 million monts. Else life without parole.

Causing death by dangerous driving – 300,000 monts. Else life without parole.

These are just a handful of examples. In all cases of criminality the alternative to ‘paying’ for your crime is life without parole. Our prisons are not full – we rarely feed our prisoners and have found that this has a positive effect on prison overcrowding.

Some of our people do not agree with our current system and would wish to see changes – liberal changes. Life without parole tends to shut them up nicely.

Murder of citizen = Gulag Camp for life or death

Rape = Gulag camp for 50 years

Treason against the party = Re-education camp or Gulag

spying = Re-education camp for 25 years and sent to work for the country

Bath Spa: Have you considered that your wealthiest citizens are given a license to kill? If they have the excess cash, and many do, they get off scot free by your system.

An interesting point. I can see how some might come to that conclusion. However those who commit more than 1 of any crime will find that they are relocated from the prosperous countryside into one of our Mega Cities. Their assets are also confiscated by the state, including any pets they may have. Most find it extremely difficult to survive in the city environment – especially as the state in no way provides them with any help.

Again there are dissenters to this scheme. Lets just say that they are heard once and once only.

My criminal justice system is much like that of the United States today. There are some changes, but many similarities. The main diffirence being we don't have the death penalty, although there is a group trying to legalize it. We also have diffirent statuatory rape laws, and thereby aren't listed.

Genocide/Crimes against Humanity: Usually turned over to the UN or a world court for sentencing. The FPS criminal justice system has never yet had a case of this type.

Murdur 1(Pre-Meditated): Life in Prison(Min: 25 years), Life in Prison without oppurtunity of parole

Murdur 2(Non-meditative): Life in Prison (Min: 20 years)

Man Slaughter: 5-20

Criminal Sexual Conduct 1st Degree (Rape): 20-30 years(Minimum: 15)

Criminal Sexual Conduct 2nd Degree(Non-Entry Rape): 10-25 Years

Fraud: 5-10 years, plus fine of two times what one steals.

Treason/Terrorism: Life without possibility of parole.

Air Piracy: 10-20 years

Drunk Driving: Depends on number of times caught. Usually fines and tickets, though one can lose his license and even his vehicle.

Rioting: Kept overnight in county jail, large fine.

Criminal Sexual Conduct 3rd Degree(Child Rape by adult): Life Sentence

Animal Cruelty: Considered as assaultt

Assault: 5-10 years prison

Assault with a deadly weapon: 10-20 years prison

Assault with intent to kill (Attempted Murdur): 15-25 years in prison

Animal Murdur(non hunting): Considered Murdur

Extortion: 10-20, plus pay back of two times what is taken

Racketeering (Used against gangsters who have too many murdur, extortion, and assault charges to all be investigated. Few have been onvicted of this): 1024 years in prison, 2.4 million dollar fine.

Tax Evasion: 1-5 years prison (mainly used to get gansters)

Of course, depending on the case, the sentencing may be more or less severe. These are just the averages. Also, my prison system is geared more towards re-habilitation than simply housing a bunch of killers.

Genocide/War Criminal: Death or (if serious enough) take a drink of the Jaque poison and be locked in Terik Island, the Ultimate prison-fortress.

Heretic Murder (killing someone cause your religion says to): Death or Jaque Poison and Red-Classed prison

Murder: Death or (if insane) Life w/o paroll.

Treason: Death or Life w/o paroll

Hertic Beliefs (believing in a religion that order you to kill innocents): Severing of Dominent Hand and shipped to the Island of Heritaven.

NOTE: Both heritic crimes have no trials. As long as the Inquisitor believes that they are a heritic, then they are sentenced.

Jaque Poison is a poison that does not kill. It actually extends your life. however, a side effect (that always occurs) is that it feels as if your being torn up by knives from the inside every second of your life. Usually extends life to 140 years. Only used on one person ever: Jaque Jolkin, brother of the former Emperor Tal-Shink Jolkin. Jaque (who the poison is named after) started the heritic beliefs and let the terrorists in the 1st Neonic Civil War.

Any person convicted low end crimes, such as kidnapping, drug use and so on, is sent to prison as normal

What happens to those convicted to Arson, Rape, Murder, and Treason is quite unconventional

They are rounded up in a 2 miles by 4 miles compound in the Arit Desert, with 25 foot high walls and automated security emplacements, and a contingent of Marines.

A river runs down the middle of the compound. The inmates are forced to fend for themselves. They receive building material from the Ministry of Sanitation, IE Cardboard, some steel, aluminum, some glass. The entire load of trash is sorted by prisons AND prison officials before delivery. Some basic tools, shovels, spades, hammers, nails, have been provided by the trash service as well.

The prisoners have to fend for themselves for shelter. If someone kills you in “Die Bohrung“ (The Hole) then you were not fit to survive. Food is provided by the leftovers from reteraunts, mostly spoiled.

Its a horrible exastance, as the Air Fleet sometiems uses the compund for target practice. Prisioners cna be used for human testing, or live fire execises. This is a wonder detruant to crime, as no one wants to go to Die Bohrung. Life is hell there.

It is a crime to commit murder. Murderers are pressed into military service and volunteered for hazardous duty.

It is a crime to commit treason. Fortunately, there is no treason in Treznor. Traitors simply don't exist. Neither do their families.

Organising or participating in a political rally is a treasonous activity. Fortunately, Treznor citizens know better. See above for details.

It is a crime to commit rape. Anyone convicted of rape is subjected to surgery guaranteed they will be incapable of performing in a sexual capacity in the future. Further penalties can be granted to the aggrieved party at the discretion of the presiding court.

It is a crime to attempt or initiate sexual contact with any minor. Minors, defined as anyone under the age of 16, are legally incapable of granting consent. Anyone convicted of statuatory rape is subject to the same penalties as normal rape, with the additional penalties decided by the legal guardian(s) of the victim instead of the victim herself.

It is a crime to coerce or blackmail anyone into any action against their will. Punishment involves fines, prison time and discretionary community service.

It is a crime to steal either private or public property. Violators are subject to civil and federal laws, depending on the discretion of the presiding court.

it is a crime to engage in slavery. Violators will have their property removed from them and bequethed to the victims.

It is a crime to commit fraud. Violateors will again have their assets seizes and distributed to their victims.

The list goes on, and is not worth describing in absolute detail.

The barilochense Penal system does not show very large penalties to first time offenders, only with the exception of treason, genocide, premeditated murder, kidnapping and rape.

The beauty of our system is that it is instituted that anyone with a criminal record (it being a criminal fine or 25 years, doesn't matter) who is sentenced again to 5 or more years, gets life without parole; and if it is less than 5 years the sentence is multiplied by 5, wether it is a fine or time in prison.

Murder- Life in prison or, depending on the quality of the evidence against the accused, a minimum of 5 years. (Ex: There isn't much evidence against Joe, but he is suspected of killing Clara. Joe gets 5 years in prison.)

Genocide/Mass Murder/ Crimes against Humanity- Our courts have never dealt with this situation, but the punishment would be one of several terrible tortures, including: Repeated dunkings in a vat of hydrochloric acid, Cutting a hole in the guilty man's stomach and pouring flesh eating insects into the hole, among other things.

Terrorism- Forced participation on 'The Running Man' a popular CF show where convicts are placed on a deserted island, and stalked by premier hunters and special forces soldiers. Not one victim has escaped yet!

Treason- Tortures similar to the Mass Murder punishments, with the added benefit of being televised.

Minor crimes including: Grand Theft Auto, Petty Theft, Larceny, Extortion, Blackmail, and Assault- 2 Years Forced Labor, or Military service

Rape- 3 Years in prison. Also, the victim is permitted to go on 'The Running Man' and stalk their rapist. Otherwise the rapist is released.

Child Molestation- Castration of the sick individual. May also be put on 'The Running Man', depending on wether the season has been good or not.

Espionage- Castration and a garenteed place on 'The Running Man'
The 5th Alliance
05-02-2004, 05:25
The worst crime is attempting to seize control of the Alliance against the will of the people, through force or some such method. It is inevitably punished with execution by a large armed mob, usually in an exceptionally painful manner.
Other severe crimes are punished with execution by the current leader of that group of the 5th Alliance.
Killing in war, self defense, or defense of another's life is not a crime. Murder for vengeance is punished with 1 year forced labor and a flogging, if the court and the Lord of that group of the alliance agree that death was warranted; otherwise, with execution. Murder committed out of rage is punished to an extent dependent on the situation, and with increasing severity each time; the fourth is usually death. Murder for any other reason is generally punished with execution or forced labor for life, depending on the wishes of the victim's family.
Theft is punished with forced labor. Half the profit goes to the victim, the other half to the government. This continues until the victim has recieved twice the value of the object stolen. If the item stolen was public/government property, four times the amount must be paid (since the government is also the victim).
Spies are usually not punished, but other crimes committed for the purpose of spying will be punished more harshly than usual.

Other crimes, and how they are punished, are dependent on the current opinions of the government and people of the Alliance.

Murder - execution via hanging.

Abuse of children (sexual, physical, neglect, psychological) - execution via decapitation, typically done by guillotine.

Terrorism - Torture via electric shocks and forced ingestion of excretement and gasoline. Death predicted within few days of 'treatment'.

Extortion - Solitary confinement in 'psychosis chamber'. Designed off the theory that what would make a sane man insane would make an insane man sane. It was discovered what would do the latter, and was implemented on the former. Execution to follow when 'the voices' command via firing squad.

Treason - Torturous execution. Process transpires as follows...

1 - Victim is tied between two trees.
2 - The body is rake over lightly with sharp razors.
3 - Tequilla or other alcoholic beverage is poured on the wounds.
4 - The stomach is opened without anesthetic and removed.
5 - The stomach is replaced with carnivorous sewer rats at near starvation.
6 - The cavity is sewn back up.
7 - The victim is covered in gasoline.
8 - The victim is lit on fire while being forced to watch the Charlie Brown Christmas Special.

Rape - Execution via electric shock.

Espionage/Spying - Torture via beatings, electric shot, consumption of excretement, and public stonings. Interrogation combined with injection of truth serums. Execution by public stoning.

Blackmail, Grand Theft, Petty Theft, Larceny, Arson, etc. - Execution via firing squad.

Simply put: sit down, shut up, and OBEY THE FIST.

Premeditated Murder: Death

Manslaughter: Death

Attempted Murder: Death

Murder in Self Defense: 6 months in jail (not official, but due to the court system this is normally how long they wait. Bail is so high, only the richest of society can escape imprisonment during trial)

Rape / child molestation: Death

Treason: Death

Espionage: Death

Terrorism: Death

See a common trend? All people are put to death for high crimes, while put in prison for lesser ones. Sometimes, with the state of the Empire's prisons, death is a better option though. Most foreigners, minus terrorists and Spies, are forced to rot in the hellish jails as to not incite and international incident. Every once in a while though...it gets interesting...

When the Emperor decides that he needs to prove a point or teach a lesson to a criminal and the general public, public executions can be used. Some of the public execution methods are as follows:

*The criminal's arms, legs, head, and torso are all tied to speeders facing outwards. At the command of whoever, those speeders tied to the arms and legs accelerate quickly, ripping the limbs out from their sockets. If the criminal is still alive after this, the speeder attached to the criminal's head and the speeder attached to his or her torso accelerate in opposite ways, decapitating the criminal.

*The criminal is tied, and then has his or her stomach cut open with a sword, spilling their stomach, intestines, and other such things onto the street. Then, guards step on these organs, squashing them.

*For rapists or child molesters or occasionally gay men, all three who the Empire especially hates, the criminal's limbs are tied so that their body is parallel to the ground and they are either facing the ground or the sky. Then, two speeders, with a huge metal spike attached between them, both hit top speed at the same time, ramming the blunt pole (7 inches in diameter) up the criminal's ass until it kills them.

*Typical beheadings...numerous ways...

Homosexuality: Internment at "Alternative to Alternative Lifestyle" Camp

All other crimes are judged on a case by case basis, but many sentences have mandatory minimums. High Lord and Emperor Usuengi Kentaka can change the sentence of any individual to whatever he wishes. Usually he gives harsher sentences more than lighter or commuted sentences.
Sketch
05-02-2004, 06:34
Virtually every sentence shall end with death. Depending on the nature of the crime, the sentences may or may not be carried out with ceremonious flair. For example, thievery is common and thus no amount of "example setting" will stop it - those caught are disposed of posthaste. High treason on the other hand, is so rare that extreme examples are made of those foolish enough to betray the state. Sentences commonly include a lifetime of torture only with the execution of the perpetrators family line (ancient Chinese dynasty style).

The laws of morality are strictly enforced in Sketch, and as our rankings in police numbers show, we are fully capable of upholding our moral code upon all the land. In order to ease the the burden on an overworked judicial system, the entire active police force was given judicial powers - all police officers (officially called judges) have the power to issue and carry out sentences.....on the spot.

Treason, Consparicy - Public Execution.
Murder - Life Sentence.
Rape - 40 years in prison, in addition to registration.
Child Molestation - Rehabilitation until deemed cured, 15 years in prison.

All these are subject to review and change. Some people are occasionally paroled due to their unique circimstances.

Crime is rare.

Being convicted of theft results in the loss of a thumb, however should Province Judicators deem the crime "a stroke of genius," the convicted may be put into a "Special Operations" training program.

Murder, of the non-dueling sort, results in public execution, and revokation of "certain priveledges" the offender's family enjoys. Public executions are carried out by the family of the victim.

Treason results in an extensive trial period, and if found guilty by the most capable independent investigators, immediate public execution is implemented.

False accusations of treason likewise, carries the penalty of immediate death.

Rape, in the same manner of treason institues independent investigation, and conviction results in the implementation of a "re-education program."
False accusations likewise will result in the same program.

Noncivil disobedience (IE rioting) may result in a treason charge, with a swifter (if any) trial.
Effrenata
05-02-2004, 06:42
In Effrenata, only those offenses that come under the Class I or Class II Nuisance category are subject to Effrenata's death penalty.

Effrenata's death penalty allows the condemned to live on death row for one year, deprived of Effrenati citizenship. If, during that time, they (or their family) can find some other nation willing to receive them as a citizen, they are deported for life to that nation, and never permitted to return.

If they cannot exercise this "escape clause," they are executed by lethal injection on the anniversary of their sentencing.

The preamble to the Articles of Confederation, BTW, includes the Prime Principle of Effrenati Life:

COMMIT NO NUISANCE

Offenses in Effrenata are categorized either as Criminal Nuisance Violations (in which case they are heard by a Criminal Tribunal,) or Administrative Violation Nuisances (in which case they are heard by an Administrative Hearing Committee.)

Effrenata has no formal Criminal Code or Laws other than those enumerated in the Articles of Confederation. These include Deprivation of Humanity (murder, assault, rape, etc.,) Deprivation of Freedom (treason, abduction, hostage-taking, etc.,) and Deprivation of Property (theft, burglary, bunco, etc.) All of these are Class I Nuisances.

Among the Administrative Violation Nuisances, the most serious Class I & II Nuisances include Telemarketing, Shoddy Craftsmanship, Littering, Public Disturbance, Perpetration of Bad Literature (amended in 1956 to include television,) and a few others.

The Criminal Tribunals must evaluate all Class I nuisances against the Pest Control Board's Severity Criteria, and those meeting a score of 10 or greater for "frequency, severity, persistency, malicious intent," etc., must receive the death penalty or else be booted up to the Pest Control Board for a hearing on a Clemency Recommendation.

The Administrative Hearing Committees have much wider latitude in sentencing, but generally tend to use the Severity Criteria for anything Class II or above. However, they hand out death sentances only rarely (although they've been very hard on Telemarketers, lately.)

Any result of any Criminal or Administrative Hearing may be appealed to the Pest Control Board for review.
