Protecting a society: Primary Law proposed.

Faced with political opposition both internal and external to allow private enterprise in Xanthal the Senate has, in cooperation with the Council, drafted a Primary Law of Xanthal. This Primary Law will function much like a traditional constitution, providing general (and some not so general) guidelines on what directions Xanthalian law can not take. The Primary Law is not complete yet, but currently contains the following laws:
-Private enterprise shall not be allowed to exist within Xanthalian borders. Special exceptions can be made for foreign businesses by 2/3 majority vote in the Senate and the consent of the Ministry of Economics representative.
-All Xanthalian citizens who do their jobs shall be paid equally.
-Xanthalian Citizens not under criminal investigation by the Ministry of Justice have the right to privacy in their homes.
-Supreme governmental power in Xanthal will rest with a Senate containing representative members selected by a standardized process of every civilian-inhabited Xanthalian planet and a Council containing representative members selected by a standardized process from every Xanthalian ministry.
-Senate and Council members shall be elected every five years; any member of the Council or Senate may be removed from office with a majority vote from their electing bodies. Special elections will be held for representatives removed from office more than one month from the end of their term.
-No citizen or legal institution of Xanthal has the right to take the life of another person unless they are either killing in self-defense or under Armada or Military regulations.
-All sentient beings in Xanthal shall be afforded the same rights.
-Discrimination will be allowed only with scientific basis.

If the Primary Law is passed by Senate majority, it will require a 100% vote from both the Council and Senate to repeal or edit.

Some comments:


-All citizens who do their jobs shall be paid equally.

So if I do telemarketing, I get paid the same wage as a banker? This takes away any incentive to follow an education or to put in an effort for promotion: after all, your conditions stay the same regardless of your position.

-Private international transportation of civilians and cargo will be allowed only on the condition that carriers match Xanthalian rates.

Watch out! Those private companies will offer higher quality at the same rates, or faster transit time, or something else related to quality and responsiveness. The result is that you lose your customers.

Normally true, Xanthal's requirement for education up to grade 15 (or age 30) and assignment of educated (and uneducated) students to jobs that need workers followed by specialized training negates that. If a citizen absolutely refuses their education, they are assigned manual labor positions. Most people who would normally fall through the cracks in the system are caught by the re-education camps though.

You wish. I'd like to see them beat our transit time or quality without taking horrible losses. Besides, if they get too bothersome the Council and/or Senate will just boot them out of business in Xanthal.

Yes, the general population of a planet elects it's Senators.

Allright thanks for the elaboration. Now, how about adding something about forbidding discrimination of any kind? That certainly gives you some points in the public opinion. (along with worker rights)
