Tragedy: 126,491 lives lost in the Dracken Nebula.

The Socialist Empire of Xanthal is in mourning today after a tragic accident caused the death of over one hundred thousand people from four nations, primarily Xanthalians. The accident occurred at 7:13 AM Earth time this morning on board a storage depot in the Dracken nebula. The depot was being used to store old Xanthalian fusion catalyst power cores that were retired from Armada service two decades ago. A computer error caused the cores to activate and overload, releasing their catalyst agents into space and causing a fusion reaction in the nebula's gasses. The resulting explosion consumed the entire nebula within minutes, leaving little time for evacuation. A few vessels made it out in time, but 526 outposts both manned and unmanned and 260 spacecraft were destroyed with all hands. Where the nebula was is now empty space riddled with debris. This accident is expected to be a serious blow to Xanthal, as several mining stations and important outposts were located in the nebula. A liability investigation is currently underway, and formal condolences and apologies have been issued by the Xanthalian government to the other three nations that lost citizens in the accident.

Crimmond and The Eastern Bloc: We thank you for your condolences. The FC cores should never have been stored in the nebula in the first place. Be assured that the person responsible for this negligence will be found and prosecuted.

Kecha: There are most certainly remains, if you could find them among the debris. Not that they would be more than a few particles of ash, but you're welcome to try looking. You are also invited to join the investigation, though there is little to do but prosecute the person who ordered the storage of FCCs in the nebula once he/she is found. We are planning to build a memorial in space near the initial explosion point that will broadcast the names of all those killed, the outposts and ships involved, and other information on the nebula and accident as well; so you are also welcome to give input on that.

I see, well, one other question, since we all lost lives, will we be prosecuting this person jointly? in a Tribunal? or does Xanthal reserve that privilege for themselves?

Xanthalian law bans participation in international courts. It also states that crimes committed in Xanthal are to be prosecuted by Xanthal, so we will be charging and sentencing the perpetrator. If you wish you may file a request for prosecution privilages after the criminal's sentence has been served here to the Ministry of Justice. Your request, if you file it, should prove that the accused committed a crime in Kechan territory, committed a crime directed against your citizens while in Xanthalian territory, and/or committed a crime directed against your nation while in Xanthalian territory.

108 of our subjects killed. This can not be borne. Who ever did this will face Teritoran Law even if it is only after they face Xanthalian law... It would be the only way we could know proper justice has been done.

I would say the deaths of our subjects is at the least the crime of criminal neglect and Murder by neglect and since it killed our citizens and Teritora is also where our citzens are, not just in Teritora proper it is a crime agaist our subjects and Teritora itself.(Quite a midievial view but own held by Teritorans)

It doesn't have to be directed, its a crime of Criminal Neglect and Murder caused indirectly that killed our subjects and as it was our subjects that were killed that brings our laws into play and they will have to face trial by anymeans nesssary, so yes it does matter according to our laws, we have brought people from other countries for trial before for killing our citizens, the host government does not have to be willing... Direct or indirect crimes are still crimes agaist our Subjects and Teritora itself.

OOC: It is always very annoying to see a dispute break out between two nations simply because they cannot agree on who will "prosecute" whoever is responsible... this is even before whoever did it is in custody... :roll:

We have great respect for Teritora and it's wish to prosecute the offender, but we will not allow our justice system to be circumvented. We will take drastic measures if we must.

OOC: You're hitting a pressure point. One of Xanthal's greatest prides is it's justice system. They are unhappy if anyone suggests circumventing it, and they will even go to war if another nation pushes too far.

The Esamopian International Court of Justice is always open... although knowing Xanthall's hatred for such courts we doubt that jurisdiction would be allowed to the EICJ, but we will still present a formal request to all parties anyway:

The EICJ (Esamopian International Court of Justice,) requests permission to prosecute the person responsible for the deaths, in accordance with international law governing the circumstances. The usally crown sentance is 5 years hard labor in the mines and consuling for each, but you forgot the negligence murder,(Don't worry all killings in Teritora that are not justifed are called murders. the punishment varies.) That carries a sentince of 10 years hard labor then an order for the convected to take care of any family members of the victims that have nobody to look after them because of what happened.

We have reviewed your 'request' for prosecution privilages of the unknown criminal that caused the Dracken Nebula catastrophe. We have determined that the accused can be released into Teritoran custody for prosecution on the following charges:
*Negligence
*Reckless Endangerment
However, we will not allow the accused to be tried for Negligence Murder in this instance. If you wish to prosecute the accused on the charges of Negligence and Reckless Endangerment, reply to this message within the next thirty days and said privilages will be granted. Note that the accused must be returned to Xanthalian custody once their sentence has been served.

OOC: killing caused by Negligence are in real life criminal and for Teritroan law purpices its lucky that they aren't going for Felony Murder which would be death sentance.

Very well even though they are guity of murder by their actions of Negligence we will only prosecute the accused on the charges of Negligence and Reckless Endangerment so there will atleast not a complete miscarage of justice.
